    Can you explain further?
Are you getting benefits paid into a different account? are priority creditors(mortgage/rent, council tax, utilities) being paid from the account you are reclaiming from?

    Absolutely agree too!

If the published price is £35, that is all they should have deducted.

If they have taken £385, that would clearly be an error and a quick call would certainly see that addressed.

But I suspect there's more to this story ...

That is just it, when I wrote to them asking for an explanation they basically told me to go away. I asked if it was an error and they would not tell me.
The letter basically said I can go to the Ombudsman, but they would object to any claim. There is nothing that the Ombudsman can do to LloydsTSB.

If the tariff charge states £35 and the bank has charged you £385, I feel sure the bank would understand that as an error. If not I'd be very surprised if the FOS didn't support your claim. Even if that failed, you would win a court claim.

However, like I said, I suspect there's more to this story ...

What did the bank letter actually say, rather than what you "basically" summize?

Totally agree with you re Lloyds, they are awfull, and have no morrells, i am just so completley discusted with the OFT & banks in this country, Steal from the poor to pay the rich, i am in no way highly educated, i have 4 children and have been made redundant twice in the past 5 years/ bank charges galore! I think the bennefit system in this country is great, but it dosn't help very much to move forward as their are no jobs to cover the bills we pay, i don't want to be a sponger! i want to show my kids that you have to work hard to have a reasonable life! but yet the goverment give on one hand and the banks take it on the other, i am completly demoralised & think i would be better off living elsewhere! even if the lloyds agreed to donate my bank charges to sports reilef i'd be happy, but isn't it great news Lloyds thinks it may be in profit next year, hope they can all sleep soundly at night!

They don't make sense to me, all their replies were confusing like they were talking about something else than hardship. Like politicians, like Gordon Brown giving evidence at the Iraq inquirey, he got laughed at by the court and those questioning him were really frustrated by lack of a straight answer, Lloyds were skirting round the issue with irrelevant relies.
    Owed out = lots.

Yes, off all banks i really hope that Lloyds have to one day repent of their sins! but they are soo clever arn't they (no morells) and given the injustice of this country will probbally get away with it!& all the tax payers money!
  • I thought long and hard about responding to the post and previous ones to it but I think I have to cos this discussion is becoming ridiculous.

i am in no way highly educated,
what does a high education have anything to do with things?
i have 4 children and have been made redundant twice in the past 5 years/ bank charges galore! I think the bennefit system in this country is great, but it dosn't help very much to move forward as their are no jobs to cover the bills we pay, i don't want to be a sponger!
You have paid your taxes into the benefit system for many years. There is no shame in claiming benefits when you are unable to find work. With regards to paying the bills have you made sure you are claiming everything that you are eligible for?

i want to show my kids that you have to work hard to have a reasonable life! but yet the goverment give on one hand and the banks take it on the other
If you teach your kids to work hard but to make arrangements when things are tight then it will be irrelevant what the government do.

i am completly demoralised & think i would be better off living elsewhere!
Why are you demoralised? Why would you want to live anywhere else?
even if the lloyds agreed to donate my bank charges to sports reilef i'd be happy, but isn't it great news Lloyds thinks it may be in profit next year, hope they can all sleep soundly at night!

Making a profit for a bank is not a bad thing.(you see I said it without any sarcasm at all). If they make a profit then the share price goes up, if the share prices goes up the government and us lot make a profit and we can sell their shares and reduce the overall debt.

Advice wise so that the saying "these things comes in three's" does not come back to haunt you. If you are ever made unemployed in the future, cancel all non essential direct debits. Pay others via either online payments or when you receive the paper bill. Talk to your creditors about your situation and what they can do to help because your income will reduce from x to y.

one final suggestion: read my signature before you jump on me and try not to bit the hand that is trying to help ;)

The counter argument to this is the report OFT1005c.

I've now read this report, and I'm not sure on your conclusions. Table C.27 shows that the average person who runs their account with a large credit balance is losing £102 in lost interest a year; yet it costs somebody who has an unauthorised overdraft between £200 and £300. So I tend to agree with the conclusion that they are robbing the poor to pay the rich... Of course I may be misunderstanding the report, or not interpreting it correctly.

I know this is more of a philosophical argument than a practical one, but I see a lot of posts defending the banks, on what I'd argue is an indefensible position.

    Regards

EDIT: thinking about this a bit more, somebody losing £100 is also being robbed... I suppose the they're robbing the rich and the poor to pay those in the middle, who run a small credit balance, and don't incur charges.
