    If after 8 weeks of submitting a gormal compliaint you have received no response, you can escalate the complaint to the FOS.

    Do you have proof or receipt the original complaint actually arrived at the bank e.g. a signature on delivery? It could be that the bank never received your complaint.

    Perhaps worth contacting the bank just to make sure?

    Perhaps contact Barclays and gee them up a bit?

    Did you send them any proof of financial hardship, ie proof of arrears plus an income and expenditure form?

    Hi NWSM,

    Yes I contacted the Bank and was given patronising advice r.e. budgetting and managing my financial affairs by their Call Centre Staff.
    Just to confirm, you recommend that I write back to the bank advising that my current circumstances are no longer relevant and explain what impact their actions had at the time of the charges?

    Yes and the poor manner in which staff treated you in not helping you and lecturing you which did not help when you were in financial hardship.

    three weeks ago just re submitted my bank charge letter utlising the template from this website using the human argument. am still waiting for a reply from A/L. the amount I am has racked up to £3500. am usually a glass half full person but on reading some of the thread responses am not hopefully. appreciate some people might say that I got myself into the problems however in some occasions the bank was somewhat overzealous with charges to overdraft amounts of £5. am not utilising the hardship route but have outlined that the circle of debt continued as I was not able to sustain my cost of living and the everincreasing charges on my account. thankfully I was able to close that account and clear my overdraft with them. so now its a case of wait and see how they respond to my letter and how far I am willing to take the case. good luck everyone with your cases and thanks for the advice on this thread.

    Which bank and what address did you use?
    You can go to the FOS but I would double check that you have a final response cos it could lead to you spending sometime before they even get to a judgement.

    Hello
    I received my further reply from Abbey for the bank charge claim using the hardship/new legal arguments. They refuse to pay anything back. Their answer to my hardship claim was basically "watch your account" and the legal arguments were refuted clause by clause.
    FO here I come...
