Do you have all your statements from the previous account so that you know how much you wish to claim back due to hardship?0 -
I filled out a back charge form recently requesting £3000 from Santander. They rung me today pretty much saying bank charges are a thing of the past and there was some court case in 2009 where everything changed. He told me bank charges were there for a reason and there was nothing he could do... do i have a leg to stand on, or is he right enough? What can i do? I dont know enough info about the whole thing to try and fight my corner?
Did he really say 'bank charges are a thing of the past' ! We wish:D
Can't advise whether you have a leg to stand on as you don't give any detail regarding the basis of your claim. Have you checked out the MSE site?

Bank name: Natwest
Amount Reclaimed: £1600 approx
Amount they paid: £94 (good will gesture)
Used MSE templates, Natwest sent me £94 goodwill gesture then I went throught FOS, unfortunately FOS was unable to get anymore from Natwest due to their T&C!
Worth fighting for, even if you don't get anywhere, at least you've tried!

Bank name: Lloyds TSB
Amount claimed: £3800.00
Amount paid: £475.00
First time poster to any forum, so apologies if I have broken any etiquette rules.
After reading some great posts on this forum, I was inspired to download the template and send it to my bank under the hardship rules. Within five days £475.00 was deposited onto my account attributed from customer services.
My only issue is that whilst I was expecting the standard rejection letter or a call regarding some form of negotiation (which seems the usual response according to other posts I have read) this payment as just been paid into my account with absolutely no contact from Lloyds TSB at all.
I must stress that I (as I’m sure the vast majority of all us claimers on this great site) am not just ‘trying it on’, but I have honestly had my life and finances put up-side down due to Lloyds TSB using me as a cash cow with ever increasing bank charges, forcing me into extending my overdraft with them time and time again then charging me additional interest charges that eventually put me £470 over my agreed overdraft. Added to this they were kind enough to give me a £1000 loan to help pay off more charges.
Until I receive some correspondence from Lloyds TSB explaining their decision to pay back just enough to but me just under £5 under my agreed overdraft and choose to ignore the rest of my claim, I’m still a little confused, but any payment must be admission that these charges are unfair and should be repaid in full.
Any feed-back as to wether I should be happy to get anything back or if should chase for the remainder of my claim would be greatly appreciated.0 -
Chase, chase, chase. I've been harassing Lloyds TSB for over four years: they're astoundingly bad at communicating and often take months to reply to anything. And usually ignore everything you've said (so keep copies).
I'm cynical but in your situation I'd see the money they gave you as a bonus and not ANY kind of settlement unless there's a letter as well - and I wouldn't accept it as settlement since it's so pitiful.0 -
Thanks for the feed-back SpikeW. I'll keep chasing and post any updates.0

After completing all my ppi claims I decided to try the same with bank charges going back from 2001. I posted my letter that i got templates from here on Monday afternoon. Today at 5,30pm i received a call from Halifax to arrange a time to contact me tomorrow so they can deal with it.
I have no idea how it will go but i am amazed they will be dealing with it in person within 48 hours. Fingers crossed.
Any advice would be great0 -

Yeah I have long since received a call. They were not prepared to offer me a penny. Firstly they said they would never go back further than 6 years.
I claimed on finincial hardships at the time. Due to me finally sorting my life and finances this year I have a healthy bank account with savings so on that basis I would not be entitle to anything.
Waiting on a letter with the exact reasoning.
Is it worth going to the fos?0 -
I had fallen behind on my Vanquis card and was being asked for £340 to get back upto date... I told them no way, I could do £150 tops... They went away then came back to tell me that since having the card (2-3yrs) I've had a total of £150odd in late payment/over limit fees, that if I make a payment on payday of £180, they will refund them which will be enough to get my account back in line. I did, and they did!
Well played Vanquis card! shame some of the high-street guys aren't as understanding?! :money:0
