  • Hello fellow MSE'ers!

    I've recently been appointed Lasting Power of Attorney for my Gdad and am now managing a £2000 debt on his behalf.

    Today, I spoke to a member of the Client Services team to freeze interest and charges and to issue me with a final settlement amount.

    I told them that my grandad is unable to repay the £2000 owing to money needing to be paid to assist with care charges and medication.

    They told me that they themselves do not handle final settlements and that my gdad would have to miss another two minimum payments for the Recovery Team get involved so I can claim hardship for my gdad and arrive at a final settlement figure.

    Reading through this thread I'm a little unclear as to whether fellow 'posters' have dealt with their query directly with the cc company or have been referred to their Recovery Team to arrange a debt management plan.

    Does anyone have any advice on how to deal with this type of query?

  • PetitMarlon, it depends largely on which bank you are dealing with. From this thread and my experience, some are far more sympathetic than others.

    But you have nothing to loose by writing the facts.

    I believe you can ask the CAB to help you although I have not asked them.

    As I said previously, some banks are more sympathetic than others and the Financial Ombudsman Services cannot make them repay anything if they don't want to.

    The Halifax (HBOS) repaid only £40.00 out of the £885 claimed despite the fact that the account holder was mentally ill, therefore unable to conduct his affairs, waited 4 months before benefits were paid and ended up seriously depressed.

    The fact that the account holder was helped by his parents seemed to give a good conscience to the FOS and be ignored by the Halifax. Would they have tried a little harder if there had been one or more suicide attempts?

    So PLEASE, read all the posts and BOYCOTT the banks hiding behind "We have applied the rules and we don't care the effect it has on people's lifes".
    Remember that any interest they pay out comes largely from people's misery.
  • On 18-12-12 I appeared in the District Court with a very expensive lawyer from Barclays Bank, this all came about because I received Judgement through the small claims courts against Barclays back in July 2012 when I applied to have charges made to by Business Account refunded. Barclays asked the courts to have the case struck out, the judge refused to do this & has given me time to re apply to the courts to continue my case.

    Can anybody out give me any guidance, or should I now give up this action and take the moral victory....

    I'm sure the judge would have asked you if you wanted to continue with a claim and, if so, on what grounds as your original PoC are obviously not appropriate. ;)
  • Also, I have two further questions:
    1. What does POC mean? I've not come across it before...
    2. With these communications between them and the banks/cc companies; have these been with the Customer Services or Recovery Teams who deal with those cases where the customer has not paid for 3 months or more?

  • Well after reading many of the forums on here and having had successes on 2 ppi claims, I thought I would try and claim back bank charges from a store card which was held at principles but managed by ikano for payments and owned by santander - confusing right? I sent an Sar with a £19 chq to santander for info held by them in particular the principles store card, including the account number, santander cashed the chq then wrote me a reply advising they acknowledge the account but because time has lapsed and the account is closed they have no records! What's even more puzzling is I still pay every month on this account, and although Principles stores are no more on our high street, I still have a store card which doesn't expire until mid 2013, pay every month and receive a statement every month, can anyone advise is this the end of the road, should I just now give up or is there anything else you can advise, newbie here so please be gentle.

    Santander and the store card would need two DSAR requests. Not one. Santandar have replied on the banking side.

    You have already wasted an amount. With successful bank charges reclaims being so rare nowadays (limited to current financial hardship and goodwill gestures) it is hard to see how you would succeed on a request for refund on a closed account.

    On the store card side, if you have statements going back to 2004 then why would you need to do a DSAR? You probably have more information than they do.
