Just before Xmas I had requested last 6 years bank statements for my father in law as he had been in really poor health for a number of years & I knew he had arrangements via the Consumer Credit Counselling Service to pay minimal payments on around £20000 of debts along with a Mortgage he had to switch to Interest Only £50k (aged 80).
A review of these statements showed in excess of £1500 of bank charges some for £35 on returned items less than £10! Clearly my father in law is in financial hardship and has been for a number of years.
LTSB have offered £40 refund for items charged in the last month but nothing else again referring to the 2009 court case.
Is it worth now referring to FOS?0 -
Hi. In Martins template letter he says we should ask the bank to give details of where our info has gone longer than 6 yrs ago. I ended up phoning HSBC for a list of all our bank charges, which they've promptly sent. Should I call them back and retrieve info on longer ago than 6 yrs? Is it worth it? Does anyone know? I have had probably about £3000 worth of bank charges with Halifax Bank, I was so skint at one point I was getting unpaid charges on charges! Any money going in was Tax Credit/ Child Benefit and sometimes it was sucked up by charges so I'd default even more.
Halifax refused to freeze the account/charges as I was still drawing money from it (Wasn't drawing any more than the Tax Credit/ Child Benefit) so to get them to agree to finally freeze I had to agree to continue having Child Benefit paid in, without drawing a penny to reduce the overdraft (overdraft was £1000, grew to nearly £3000 with charges)
The money I did have to throw in to try and stop MORE charges was always money I didn't really have, so I defaulted on many bills and ended up having an attachment of earrings for Council Tax (2 years in a row).
I have just been informed that Banks are not allowed to stop access to benefit, would this count in my hardship claim?
My Child Benefit has been paying off this overdraft for the past 2 years, so I have shown willing to pay. I was showing willing (when possible) before this agreement, but felt backed into a corner.
Any advice greatly appreciated, want to get the claim right first time0 -

My martner and I have just decided to go for reclaiming our bank charges, we have been in hardship, giving up luxurys like, sky, life insurance and a car, mainly because of charges by the bank, we had went in to the bank and asked for their help, but they couldn't help us. We now have an ongoing investigation into our bank because i filied a complaint about my branch, we are now about to send out our letter asking for the past 6 yars of transactions. Has anyone had any joy with reclaiming bank charges back from the clydesdale, or will we be fighting a loosing battle.:)

Giving up luxuries is not financial hardship - it just means you are no longer spending your money on luxuries.

Any claim for a refund of charges incurred whilst you were spending money on luxuries is certain to fail, sorry.0 -

The story: Wrote one letter to llyods giving my situation, and got a cheque one week later. Having spoken to the bank this is all they are prepared to offer, but the agent on the phone encouraged me to complain to FOS about the difference.0 -
My Bank charges over last 6 years amount to nearly £2000 and have just been made an offer (It was only over the phone by a Manager) of £616 half of my reserve usage fees of the last 6 years but refused to return any guarented transaction fees. Any ideas how I can try get them to rethink the offer a little without jepodising the offer they have made? : )0

Don't give up i have just had an offer for half my reserve usage fees and looking for advice to get the offer upped a bit They use something called Trigger Figures which are set out for what you can spend and still be classed as being in Hardship I got a big fat no and made a complaint and found out they were just judging it on only me living in the household not my 2 children and for everything but last 6 months they had to take into account my partner too. I asked for a manager call back and it worked wonders : 0 ) Good Luck and don't give up:beer:
