This would depend on if they were living with you at the time: if they were and subsequently moved out taking the PC its would be viewed a theft, as you can prove ownership as you have the receipt; if, however, you were living apart, then they are right as it would be looked upon as a gift, and therefore, not theft. You could apply to get a court order to seize the goods, but this could prove to expensive.0 -
But surely the fact he was making payments on the computer proves it wasn't a gift.:A

Wish I'd had you when I needed it. I ended up paying for everything my ex bought on my credit card on the net including a shed!!

Just to second the recorded letter thing AND if you have them then keep the text messages with him saying that he won't give the PC back as he needs it. Any texts like that - keep them! Just in case the judge will consider them evidence.
I would send him a final warning and give him a certain amount of time to respond with the full and final payment before you take him to court. Maybe that will get him to get his butt into gear

When my parents were divorcing, my brother still lived with them, then he moved out taking the PC they had given him. But my dad reported to the police that my brother had stolen it! An officer visited my parents but my mum paid for it on her credit card and showed the officer the receipt. Because she confirmed it was a present for my brother it didn't go any further. So if you tell the police he has taken it without your permission, then they should treat it as theft. Maybe just the threat of reporting it will make your ex pay up?Marsh Samphire0

I have been bitten too, in a huge way. My ex (who I had been with 14 years) ran off with the nanny, taking the credit cards he had on my account (second card holder) and ran up 25,000 of debt in less than a month all in my name and there wasn't a thing I could do about it. He spent most of it before he even left so by the time I found him gone and I cancelled the cards the debt was already there.:A

CALL THE POLICE AND REPORT IT STOLEN. If he says it was a gift, he has to PROVE that was the case - you have all the documentation to say it's yours. And he has no proof of ownership at all. i find sometimes the police can be very accomodating when dealing with situations that could get dangerous, like you going to repossess an item that might not be given up voluntarily.
i had this situation some years ago, with a friend who i helped by paying for his stuff on my credit card. same thing, he left, didn't pay and i was stuck with bill. when i called to ask him for the items, he said he didn't want to know. i asked at my local police station and though it was a civil matter they were happy to accompany me to repossess the stuff from ex-friend.
you never know, all you can do is ask.
hope you get it sorted soon.MFW Newbie - #17. (#116 in 2019)
