    Exactly which (unless they absolutely were) could get them in a whole pile of trouble too... it wouldn't have been taxable at that amount but they would still have needed to declare it.

    The rent a room scheme means that anyone can rent out there spare rooms.

    Regardless of wether your OH lived with you or not you may have been jointly assessed for benefits anyway as he'd lived with you previously and you were still a couple. Just because you live apart doesn't mean you're automatically assessed as 2 individuals for benefits so it may be immaterial where your OH lives (or doesn't).

    was he using your address as his or was he using it as a care of address, for example
    mr jones,
    c/o 1 abc street,
    would i be right in thinking the c/o would make a difference?

    But you still have to declare it - when I was in this situation I had to complete a tax form, although my salary was PAYE.

    Lets try and get some perspective on this....You stopped claiming and then got married.
    It is more than likely that they will have a copy of your marriage certificate which will presumably show your address for the both of you at the time that you booked the marriage.

    He started work - did you say 2 years ago - when he gave your address. Who did he give has his next of kin, or the person to be contacted in case of an emergency? Was it you? Have you ever phoned in for him if he has been off? Has anyone from work ever contacted him at your house/dropped him off after work? What contact number do they have for him. (As is is the council interviewing him and they are his employers it is possible that they have the answers to these questions)

    His bank account is shown to be at your address. His mail is delivered to your address. They will probably have credit reference searches which may or may not show any other applications that he has made using your own address. Do you have any joint accounts/loans?

    By your own admission he lived at you for 2 weeks when he started work, why did he move out?

    Do the school/nursery that your child attends have him on the list of people that can pick up the child? If so, for how long. What contact number do they have for him - is this your home number.

    The council will only have to believe on the balance of probabilities that he did not have a room somewhere else. He doesn't seem to have registered for council tax at his 'other' address or on the electoral roll. He presumably doesn't have a rental agreement for the 'other' address.

    Whether or not they have any surveillance evidence I would imagine that there will plenty for you to discuss at your interviews.

    No-one can tell you what to say, but you need to be prepared and not give a half-heared story that is full of holes. If you are telling the truth-usually it can be proved.

    I find it very strange there isn't a trace of any kind of evidence to prove he was paying rent at these other addresses.

    If I were investigating this what I would find most difficult to believe is that an adult man could live in two different places over a two year period and have absolutely no proof whatsoever that he was doing so. It just isn't credible.

    Why are you even worried?

    Nothing will happen to you.. you wont go to prison, probably wont pay it back and will still have all the perks available to you again :rolleyes:
