We all know that life can get in the way, but your biggest sin was not communicating with your buyer. You should told them that it had been sent late and apologised and offered some recompense. That would have kept your buyer on your side. Now your just firefighting

Hi just to let you know I sent a parcel 1st class recorded on the 1st of december and it only arrived on the 15th so please be patient royal mail is a joke.

    Hi,

I sent an item sold on ebay yesterday and it was delivered to day - recorded signed for, I find royal mail to be pretty decent with regards to items I send.

  • Hi you asked what your obligations are as a private seller well if you state on your auctions posted within 2 days that is what you have to do it is the same for all sellers private or business you must post within the time you say you will or quicker.
I would now go with a partial refund and a very apologetic message to try and stop any negative feedback getting put on your account this may still bring the buyer round.
  • I bought and paid for something yesterday and got it delivered today, on the other hand bought and paid for something last Saturday, the seller said they sent it Saturday and I've still not received it

It's always best to let buyers know if there is going to be a delay. Posting 2nd class at this time of year is pretty risky especially this close to Christmas.

  • Sellers have to quote a dispatch time. They cannot ever quote a delivery time.
I have bought loads off amazon for Christmas they are giving approximate days before dispatch. They email when dispatched (as I do). Then I wait until the courier comes. Nobody can tell me when it WILL arrive.
  • no but they stated a dispatch of 2 business days and didnt stick to it, instead they took 4-5 business days (depending on time of sale and posting!!), that is what messed up delivery, and the seller is responsible

I sold an old MP3 player on eBay for £28 + postage (Royal Mail 2nd class recorded).

    The auction ended on 9/12/2009.

I state in my auctions that I usually take 2 days to post, and RM takes around 4 days to move a parcel 2nd class.

As it happens I was a bit busy last week with everything and didn't manage to post it until Tuesday 15th - Post office said it would still arrive in time for XMAS.

Buyer is now hassling me saying he wants a refund if the item does not arrive today because he has made travel arrangements and wont be able to sign for the parcel which is a gift for his son.

What are my obligations as a private seller?

p.s. I have 100% feedback from over 430 purchases and sales.

Did the buyer pay on the 9th or later, depending on when the payment was made then you could have a fair reason for posting on the 15th. If for example I sold an item and didn't receive payment for 3-5 days then I would only post within 3 days of date of payment, not 3 days of auction or BIN listing selling.

    Just a thought

So, did the parcel arrive today?

You really should have sent it special delivery given you said you'd post it in 2 days, but took so much longer.

Have you let them know that you didn't post it until 15th December?

As you only sent it second class, then they could just open an "item not received" dispute and get their money back.
Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')

No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

xmas is not the time to delay posting items
the mail/packets builds up through December and with diversion sorting isnt always sorted/delivered in sequence
  • no but they stated a dispatch of 2 business days and didnt stick to it, instead they took 4-5 business days (depending on time of sale and posting!!), that is what messed up delivery, and the seller is responsible

Oh yes I agree with you. A seller should dispatch when they say. But people seem to be mixing up giving a dispatch time and a delivery time.
We can promise to dispatch in 2 days, but can never say when an item will be delivered.
