So I will be out of pocket of £35 and my original postage of £7 total £42. That can't be right.
Did you phone ebay? Have you heard back from this guy yet?
From his previous messages to you, he doesn't sound keen to send it back and wants a refund first, so he might not send it. I would pursue this hard with ebay and point out that all he has to do is go into the shop and get a new one, and you suspect he's tampered with it.Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')
No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)0 -

Since Emailing him about returns haven't heard from him since and he hasn't done anything on eBay via the resolution centre to start a return.
Just goes to show, I spent all that time sending him detailed replies to try help him yet he cannot respond with 'Yes I will return item' or any kind of acknowledgment of my last email, so I don't know what he is doing:rolleyes:
eBay told me that via a dispute that they would get him to return the item and that if there is any problems with the returned item to contact them straight away. I got the impression that they didn't really give a !!!!.
Regards the FVF, I found that you can get it returned but it has to go via the Resolution center and the buyer gets a say in whether I should get my fee's back or not, great:rolleyes:0 -
thats a 'mutual'
as you say if the buyer doesnt say yes then its no joy0 -
Hopefully the longer you wait for him to reply the better, if he ever does. The fact that you did not meekly roll over may well have put him/her off.I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0

Just to update. Got a Paypal email about 1/2 hr ago. He's put in a 'item not as described dispute' for a refund however he wants postage by the looks of it. Here's the paypal message he entered.
'i have send you item with all accesories i have send in 1st class so its should with you by tommorow morning so now please can you refund me please plus with my delevery charge £6.75
thanks'
I don't have to pay his delivery charge do I? Shall I wait for the item before replying back or tell him I'm not paying him his delivery charge.0 -

Yes I think its Special Delivery as I paid £6.70 for it. I not fond of paying his Delivery charge though, I'm sure he will have something to say about it.:rolleyes:0 -

probably he will have something to say about it:D personally I wouldnt refund his postage back - would depend on circumstances etc - but I would also make sure the phone is as sent - whether he has done [STRIKE]much[/STRIKE] any damage to it:D and that all security markings, imei numbers etc match upWeight Loss - 102lb0 -

Woohoo! I'm normal! Gotta go tell the cat.0 -
DONT refund until item with you. I dont think you have to pay return postage but if he gets refund then you may have to pay back the original postage from when you posted it to him.
Hope it arrives in one piece with nothing been purposely broken! Oh and get it checked out before refund!
Good Luck!:j0
