    I have had two tickets from Excel at a car park in Oldham. The first one I received was because my car was parked incorrectly in the bay (my tyres were on the white lines), not having had one before I paid up straight away. I then avoided parking there for as long as I could (I need to for work), but unfortunately I had to use it again. The very next time I did I received another ticket for overstaying my ticket - the machine had issued it incorrectly, even though I'd paid the correct amount. I sent off an appeal to the company which was rejected, I sent another, which was also rejected and was told not further appeals would be accepted and to pay up within 7 days.

    After reading this forum I'm now considering following all of your advice and not paying up but am slightly worried as I still need to park there on a daily basis - what if my car gets clamped??? Advice would be most appreciated...




    Cars can only be clamped if there is signage up, very clearly stating the risk of clamping and the fee for clamp release. And then they can only clamp if at the time you park there, the driver breaches t&cs in some way (not to enforce a previous alleged debt). And if you are ever clamped by a private firm, 99% of the cases are unlawful in some way (signage issues, SIA licence or receipt issues, extortionate amount = an unlawful penalty, yadda yadda...). Most people could sue for their money back if they knew who to sue, how to do it and if they had some time & could be bothered.

    So look at the signs in that car park. No mention of clamp release fee = no contract to pay them anything to release a clamp. No mention of clamping at all, only warnings of fake PCNs? That's fine, no need to worry. I park weekly in the car park where I got a fake PCN and ignored it. The high-vis-jacket wearing 'staff' would not have a clue which cars have previously had a fake PCN. They just log that day's arrival times & car regs in their little hand-held thingy and stalk around looking for cars to put spoof tickets on - that's all they know.

    And never pay one of these again, it pained me to read your second sentence that you actually thought you had to pay a parasite company leaching off the back of a real business car park, just because your tyre was on a white line. !!!!!!, it wasn't the Police or Local Authority so it was never a 'fine'!
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    I ask this as that would be different to the other 5000+ ppc threads, and would genuinely be of interest.

    There's no interest in being told that you've just got the same chain mails as everyone else.

    I guess I am just posting for reassurance.
    I parked at the Crown Point retail park in leeds on 22 June, I came from the car park, to the cash point over the road and then to the Coasta coffee at the other end of the park. Officially I did leave the park and reenter as a customer. I got the ticket, didnt know about this scam at the time and I wrote to appeal, sending a photocopy of the receipt from costa. They turned it down of course, but said I then couldnt pay the reduced within 7 days fine, but the £60 one, which needed paying within 7 days. I wasnt happy but paid the £60 as online payment at 10pm one evening, but the payment didnt reach their bank until the day after, so now they are saying I paid after the 7 days and owe them an extra £82. They have got Roxburghe onto it and they have started texting me asking me to call them. I havent called back or contacted anyone about this and from what i have read here, I dont intend to. They are getting the solicitor onto it.
    I suppose I have admitted "guilt" by sending the £60, but surely a court would consider it unfair as they are now punishing me for it reaching their bank account late.
    Just needing reasurance. The letter points out that they are aware of internet sites (like this one) claiming the tickets are not valid and they redirect me to somewhere I havent bothered looking at.

    Just ignore the greedy scammers, they have had their pound of flesh! Their solicitor Graham White is a joke do not give them a thought. Just ignore everything they send you!

    They quote internet sites like this saying these tickets are not enforceable. Yet they have never enforced one, they did issue a claim but when a defence was entered Sobell didn't turn up.

    Where were they directing you to?

    You have paid a scammer like all scammers they come back for more money and will continue coming back for more money until either yourself or someone else steps in and brings some common sense to the situation
