isn't the sign itself completely illegal?Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
They are all or have been suspended from accessing the DVLA database for gross misconduct!
Do you really need to ask what kind of people run parking companies?0 -
I'd warn to take care if deciding to cut off a clamp. The clamp owner can complain to the police about criminal damage and the police will more than likely charge you, and they won't care about whether the clamping was legal and say it's a civil matter. When the new laws come into force then it will be a different matter. For now if you cut off a clamp be quick and leave no evidencesarahg1969 wrote: »In fact, they could well be breaking the law by threatening to break the law!0

Hi,
I've also had a ticket from the same Stockport car park from Excel (as per original post), that I aquired back in August. I came on here at the time and read a few of the posts and decided to ignore. They've sent me a few threatening and (misleadingly) official looking red letters, hiking the charges up each time and threatening court action.
Today i've had a letter through from Roxburghe debt collectors, explaining they've taken the debt over and "in the absence of any payment or valid dispute, we will pursue the matter...with our solicitor Graham White, who will review your case for potential legal action".
What do I do now?? I've never had any contact with debt collectors before and I'm not sure how valid these claims are. Does this mean my case is on it's way to court? Should I contact Excel to appeal? Or continue to ignore? Can they come to my house to 'collect the debt'?
Before this letter, I was quite prepared to wait it out and see what happened....now i'm not too sure?
Any and all opinions will be much appreciated, particularly if you have had personal experience with the same circumstances!0 -
Just ignore. These are standard scare tactics I promise you.Still waiting for Parking Eye to send the court summons! Make my day!0

And the Police cannot help you, they'll tell you it's a civil matter and/or quite possibly will get it wrong and say clamping's not illegal yet. In fact it is IS illegal to clamp to force payment of an alleged debt.
And in case you are wondering, don't bother with the CAB, they are hopeless with their understanding of this matter.
If in the unlikely event that it happened you should either cut the padlock off (that WAS a serious answer!) or sit in the car and call the Police, calmly pointing out it's not legal. Or take a day or so to get an injunction to force them to return your car, or pay under protest and then sue them and whichever sad company contracted them.
Stop panicking. I still park every week where my vehicle got a PPC ticket and of course I ignored it, so do loads of people on these forums. Sometimes us regular posters deliberately bait PPCs by going back to the same car parks and parking over lines, overstaying etc just to waste their time and money. Scammers deserve it.
I had an email back from the police they said that if Excel have a licence frm the SIA they then ARE able to clamp (until November) and/or tow away my car if it is parked on their land.
Like I have said before I have NO intention of paying the fee but I really don't want a clamped or towed away car I do not have the time (or money) to be dealing with that.
I also have full intention of making sure people in my office know that they do not have to, and should not pay another penny to Excel but as for me and where to park my car from now on, I still don't know.
I have been paying £3 a day for 18 months to these people and don't want to give them another penny!0 -
The police would say that, they have never understood this scam in the main and very few prosecutions of rogue clampers for blackmail have actually happened.
That's why the clamping ban is coming in - because scammers were out of hand and the Police would not or could not deal with it. Goodness knows why, they obviously had better things to do like traffic censuses and pointing speed guns at people doing 33 in a 30 limit road...PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

You didn't do enough reading when you first got the ticket.
The Roxburghe/Graham White letter-chain is clearly shown in pictures in the top thread on this very board 'PPC letters/threats, what to expect'. Read as many threads as it takes till the penny drops that EVERYONE here has heard of Roxburghe & they're a waste of space:
http://forums.moneysavingexpert.com/forumdisplay.php?f=163
And you could have googled them, here are the results from pepipoo forums alone:
clicky pepipoo Roxburghe results
Then finally settle down to read this pepipoo thread in which Alexis shows catagorically that Graham White are not real solicitors, they are just another name used by toothless old Roxburghe passing themselves off as 'GW' in letters or phone calls (= harassment):

Debt collectors are nobodies with no powers, they cannot affect your credit rating nor can they send the boys round because they are NOT Court-appointed bailiffs.
HTH, happy reading of the links. Nowt to fret about as they NEVER do Court, not EVER.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I guess I have 2 weeks before Excel expect my ticket to be paid - I AM not paying it but think I will be finding another car park to park in after my 2 weeks are up.0 -
To show your annoyance just continue to park there across two spaces and don't pay to park there or any tickets.0
