TAX Disk didnt arrive, Fixed Penalty Notice!

  • I do 20+ tax discs per year for work. Reminders come to me around the 5th of the month in which they end. I order the tax disks as soon as I get the reminder, and usually get the disk 5 working days later at most. Never had one not turn up or late. No sympathy from me, I'm afraid.
    As for driving without insurance, why not just do things properly and get drunk before you crash?

    Well I have not read through all the posts but my sister found herself in a similar situation.
    She is not best placed when it comes to paperwork! She had ordered her Tax disc online paid for it ....then cause bill paid duly forgot about it. Until a FEW months later(can't remember how many but more than two!),she got a FPT issued buy a traffic warden(but should not make any difference). She wrote to the ticket office explaining that she had not received her tax disc.
    In the meantime DVLA would not re-issue the tax disc through the post, she had to go to the local DVLA office to get a replacement.

    The ticket office then put a line through the FPT notice and she was not required to pay the fine.

    BTW, Whether a vehicle is taxed or not can be checked by police on the Police National Computer although this is not always relied upon!

    Verbal warning for fail to display if the disc is carried in/on the vehicle is the order of the day for that.

    DVLA in Swansea don't reissue lost discs.

    You always have to get them from a local DVLA office.

    But you don't have to go in person. Download a form on line and send it by post (with the fee if necessary) and they send a replacement out to you.

    No, the whole idea of 'tax discs' whether displayed or not is what is absurd, there's no reason to have them, they are a useless relic of a bygone age.

    I'd say you should read all posts in this thread, and then contact your local ticketing office and make some of the ponts raised in this thread (which has been interesting reading).
    However you should have bought from a P.O. you put your faith in....

    Any one of which could have caused your plan to fail. You should have bought one from the P.O. on your return from holiday, and then told them to refund you for the online one which had not arrived.

    It doesn't matter that you paid for tax, and it was not sent in time, the offence is "failing to display" and comes into play after 5 working days from date of expiry. However from some of the advice here it seems possibly only to apply when there is a driver present for the FPN to be issued to.

    As a point of interest, I think you will find that an uninsured car on the public highway can be removed, impounded and crushed, so if anyone thinks the idea above is a good one, it really isn't!

    Surely a very silly strategy, which means anytime you drive your car on the road you risk getting a ticket. And possibly also when you park it on the road, although the ticket in this instance might not be lawful.
  • Well I have a company car and had a similar issue back in August. I was going to France in the car on 24th August for a holiday, work told me the tax disc would not arrive in time and I would have it when I got back from hols which was 5th Sept, this meant I would be driving the car for 5 days without a valid licence disc in the window. When I queried this with my employer (a large blue chip company) they told me as long as they had purchased the tax disc, I would not get fined even though it wasn't on display.

    I now work for a different employer and have had the same issue. The car I have now again is a company car, the tax expired on 31st Oct, but the General Manager didn't order the disc until a couple of days before the end of the month, I only received it yesterday from her so again have been driving around for a week in a car without a valid disc displayed.

    Can anyone tell me if I had have been caught by the police who would have been at fault here, me or my employer???

    i think its its the same as if your driving around with bald tyres,you get fined not the employer.

    In this instance, the officer obviously elected to deal with the offence by way of issuing an FPN.

    I've seen them issuing FPN too to unattended parked cars, but it could be argued that issuing to the driver never took place, because there was no driver there. So there may be room for challenging the procedure taken.
