TAX Disk didnt arrive, Fixed Penalty Notice!

i bought and paid for my tax disk online 5 days before it was due to expire. I put the email confirmation in my window just incase it didnt arrive within the 5 days.

went on holiday with strict instructions for my housemate to put the disk in the window once it arrived.

i get back 3 weeks later and there had been no tax disk in the post (i assumed it was because of the postal strike). so i rang the dvla and requested a duplicate. im awaiting it to arrive i the next 2 or 3 days.

Today I went to get into the car and find a fixed penalty notice on my window (issued by a police officer).

Should I begin court proceedings? or pay the £60 fine? seems mad that i took my account into more debt of £100 for my tax and then it doesnt arrive in time and i get lumbered with another £60 outgoing. especially when im out of work due to the governments terrible running of our country!

Court? or pay £60? ideally advice from those who have been in similar circumstances.

    failing to display. i have paid my tax but am still awaiting the disk to arrive.

    to the trolls... you chose the most boring forum ever to spend your time on. maybe get a hobby or something?

  • i had not received my tax disk due to an error in the post or the tax people. is it my fault i didnt receive it? why would i buy a tax disk and make a concious decision to not display it?
  • my point is that i can prove i was awaiting my tax disk in the post. and can prove it never arrived, and prove i had a confirmation of payment on view in the car.

    it troubles me how you can have so much time on your hands to spend getting in the way of my query.

    please can someone tell me if its worth going to court or not?
  • You failed to display for 35 days and were on holiday for 21. I can't see much of a defence.

    The "confirmation" in the window can easily be written up by oneself - and it's not a Valid Tax disc - proof of nothing.

    Why leave it to the last minute - asking for trouble especially leaving it in the hands of someone else.

    I'd pay up.
    also as it's only £60 - I bet they checked to see if you had a valid license - otherwise it would have been towed.
    £60 is simple for not displaying it as required by law.

    I suspect you're going to have to cough up for the fine. Sorry to say it, but you've just left it too long before raising the point that the disc hasn't arrived, and unfortunately the offence is failing to display a valid vehicle excise license. What have the DVLA said now about getting a disc to you? Your biggest problem now is that you potentially have a local plod who can stick a VPN on your car everytime he sees it until you have a disc on show......!

    Oh, and best not to feed the trolls. They've been reported - hopefully your thread will be cleaned up soon to remove all the rubbish.

    i was about to give up on this forum. thanks for your reply.
    i requested they send me another disk about 4 days ago. should be here soon. was sitting waiting because of the whole postal strike. should have known better but thought the printout of the receipt would be enough and the police would check the tax on their system and maybe consider that the postal system hasnt been helping me much.

    im gonna move the car and hide it on a less popular road i think. it is quite terrible how the police can do this. the whole displaying of tax disks is obsurd when the tax info is on a database anyway.
