TAX Disk didnt arrive, Fixed Penalty Notice!

    Failing to display a vehicle excise licence ceased being an offence dealt with by Police years ago ..."when an excise licence is expired or not present proceed by CLe/2". (CLE/2 is a form to forward to DVLA who have responsibility for issuing fines now).

    I suggest you contact the ticket office for your local police force and enquire re the legality of the ticket.
    Why advise someone to pay up when the offence is not one that can be dealt with by the Police any more?:rolleyes:

    3.2.3. All offences of failing to display a vehicle excise licence and
    using or keeping a vehicle without an excise licence must be
    reported on excise offence report form CLE 2/6 or, for
    vehicles over 1,525 kg weight, on forms CLE 2/7 or an FPN issued to the driver.

    In this instance, the officer obviously elected to deal with the offence by way of issuing an FPN.

    Thing is Edinburghlass couldn't take the car out on the road till post arrived on Thursday!

    As there was no "driver" in this case it should have been a CLE 2/6. South Yorks Police have had the right to issue FPN's for this offence removed as have other forces which is one of the reasons I suggested the poster contact their local Fixed Penalty Ticket office. The actual offence was decriminalised along with parking offences years ago but obviously Hampshire still issue FPN's.:)

    3.4. Vehicle Unattended
    3.4.1. If a vehicle is unattended, or is seen to be driven without a
    vehicle excise licence displayed and is not stopped, all
    reasonable steps must be taken to locate and interview the
    driver before completing an excise offence report form.

    Actually you could have taken it out as you have 5 working days at the beginning of the month (as long as you have bought your tax disc online/by phone) when you do not have to display it to allow it time to arrive in the post This only works if you have applied before the old one runs out.

    (a) it not just Hampshire Police that issue FPNs for this offence.
    (b) no excise offence report form has been completed. (yet). The officer elected to deal with the offence by way of an FPN.

    Q665: I have ordered my tax disc on line but it will not arrive before the end of the month, can I drive my car before it comes?

    If you choose to drive your vehicle on a road without displaying a valid tax disc then you commit an offence and risk getting fined.
    However there is an exemption for the first 5 working days of the month from displaying a valid tax disc. The exemption will only apply in the month when the tax disc commences and where an application for a new tax disc has been made before the old one expires. Drivers should continue to display the previous tax disc until the new one arrives. After 5 days the offence will be committed if the new tax disc is not displayed
    Purchasing a tax disc on line can take up to 5 days so make sure you do it in plenty of time.
