At this stage I am uncertain whether supplying a backup copy of Windows operating systems breaks Microsofts EULA.
I have therefore contacted Microsoft with links to XL, and asking them to comment.
Since you clearly have not read all of the thread - you won't mind me mentioning YET again for the clearly bandwagon jumping crowd.. that you have not got a bloody clue what you are talking about
We run a service
Clients MUST own the copy of what they would like duplicated
They MUST tick a tick box agreeing LEGALLY that the duplicate we product will be used as such for a backup purpose only.
The duplicate we produce is then sent to the customer.
That is how it works - no loophole, just totally LEGAL.
It is not piracy at all, piracy works as thus.
1. Person goes to pirate
2. Person asks for (x) title
3. Pirate sells (x) title to person
4. Person goes home with (x) title
In short, this is piracy ^^
What we do is a duplication service ONLY for this kind of media.
We DO NOT offer keys/serials etc on the site. Clients MUST have them already.
Nothing illegal.. nothing Microsoft could do.. but if they wish to contact us at info@xltrading.co.uk they are more than welcome.
And we can then advise them legally that what we are doing is NOT piracy, nor would we wish to do such a thing.
So once again for the stupid hypocrites on the thread.. you have been told for now a possible 3rd/4th time we believe
- And the clock is still ticking until MSE pull this thread.They're providing a back-up of software that has not yet been released to the general public, so it's quite difficult for anyone to currently hold a valid copy at the moment.
Especially considering Win 7 isn't released until 22/10/2009, so being able to provide back-up's to software not currently available is a very good achievement.
Really.. so you have no clue that stores which already have this in many countries ready for sale - may have sold us an out of release date version.....
Again, this is how we get brand new items - quite simple really.
Personally, I went out and purchased GTA4 for XBOX around a couple of weeks before the release date from a major supermarket in the UK. Is this legal? I believe it is on my part - is it legal for the store to do this?
Not a clue. But they sold it to me, I paid the cash.. the transaction was complete.
It is the sales assistant that is at fault I believe in this case.
Exactly the same in major supermarkets. Cod MW2 will be available to buy 'before' the release date as well.
Halo 3 was I believe in a lot of stores hence Microsoft suing because of it.

XL trading are not a Limited company, they may or may not be a sole trader - but either way they have to show their business details if they are trading.
There was a company called XLDS Limited operating from the same address, well 230A Elm Lane (there is no such thing as 230A - but anyone can put A after their address, the post will still get to you).
This company was dissolved earlier this year for non-compliance and seemed to be something to do with debt collection services according to companies house data - which is also publicly available data. I'll not mention the names and home addresses of the individuals at this stage as it is entirely possible that this business has had it's details hijacked and/or were the 'previous owner' of XL Trading

Using the same avatar and seeming to have a very similar problem as a certain XL Trading, by the look of things, XL is looking to switch websites very shortly to the .net domain.
But it couldn't be our very own XLT could it?
Tim's Ltd company no less.
And I doubt he will take kindly to you posting information about his which you do not have his consent to do.

We have also reported this direct to Nominet.
Nominet customer reps do seem to be talking rather a lot of information from 'XL Trading' owners at the moment it seems - which they were quite shocked about when discovering they had committed an offence by clearly not following data protection guidelines.
Again, the address being posted is Tim's house in Sheffield - a private residence which he is quite, and rightfully so - a bit miffed about that people are posting home details when he has nothing to do with XL anymore.

However, a legal declaration is in place WHERE if they tick it.. we can complete the order for them.. and they must tick it to use our service.
The tick box legally absolves us from any illegal activity that the client might do (not saying they do as we to be honest, is not for us to decide) - it is the same as signing a legally binding contract on the site, you tick it - you abide by it.
Them's the UK laws on copyright peeps

Nothing personal published in my post, but thank you very much XL for now associating my purposefully vague description to an actual person.....oops, you may have defamed someone;) do let Tim know (which is odd, becuase Tim is not the person who is registered at this address anyway so either Tim has used false n ames on a Companies registration (illegal) or Tim is actually someone else whose name I'll not publish in order to add an air of mystery to proceedings.
Besides, I could publish it if I wanted to as it is public domain information strangely enough and does not require any prior consent - that is the thing when you are a Director of a company, the law does not allow you to hide behind walls (unless you are Tesco's CEO, Sir terry has a special opt-out in law due to potential terrorist attack).Anger ruins joy, it steals the goodness of my mind. * Business partner has left
* Nominet has contacted us today saying they are effectively cancelling the WhoIs opt out and that we have to use a new domain name as we cannot trade on the .co.uk
Help... not done anything like this before, and we run quite a large store pirate online- what do we have to do?0 -
