Proof of post or posting not proof of postage, it's not a stamped addressed envelope.

You say 'something which is true is not defamatory'
So then, you and everyone else on this thread could legally prove with evidence, that we are doing something illegal in regards to the Sky cards or the backup service we offer to clients OWNING the item before using us?

You could totally agree to that statement could you? On this forum and this thread?
You have proof we 'tamper with the Sky cards' - which has been noted previously on this thread and you also have proof that we are pirates, who sell 'on carboots' and conduct illicit activities on the net?
You can prove all of this can you.
Good luck mate - I really hope you can prove that - if you cannot, that is clearly defamatory comments :)

I am not obliged to present any evidence about you tampering with Sky cards, since I have made no such allegation. Your assertion I have is a work of fiction.

If you present any evidence alleging that I have, you would quite likely be committing perjury and conspiracy to pervert the course if justice, which is a criminal matter, even when relating to evidence in a civil case.

As amusing as this thread has been, it's distracting me from my work. ;)
Is my understanding of XL Trading correct? It seems as if that as long as I say that I have a legal copy of a DVD / Game / Software, then they will supply me with a 'backup' of it at a much cheaper price than the original? So presumably, their get out is that I must've told porkies when I ordered my 'backup?'

I still don't get how posting publicly available material such as details on a WhoIS look up can be deemed as breaching Data Protection, when it's Publicly available and can also be requested under FOI.

Also if XLT was to relay on this thread for prosecution purposes surly having it deleted and removed would deny the defense access to necessary information, and thus render any court action one sided and therefore biased, making the court case useless, and unlikely to go ahead.

So I suppose if he wishes to suppress information that could be used in court, then he's only doing his own case harm, and costing himself a shed-load of money in lost court/lawyer fees.

We have now spoken to Nicola at TheBunker.net and she has advised us that Brendan 'owner of this forum' has 24 hours to sort this out.

TheBunker.net has advised me that they have read through this thread and agree with us on some of the questionable posts upon it including the releasing of Tim's address details when he is no longer connected to XL.

I would advise Brendan that he really needs to sort this ASAP and delete this thread as TheBunker.net DO NOT wish to appear to advocate any libellous or defamatory posts on their hosting.

Thanks Nicola - keep us informed :)
MSE now has 24 hours to resolve this problem - tick tock.
Just to confirm, XL Trading does have the right to reply but this does not mean MSE endorses its products in any way and, like all other forum users, must help us keep the forum a friendly place to be.

The problem being, DID anyone have the written permission of Tim to disclose the WhoIS information on a 'public forum'

Posters neither have OUR permission to post our WhoIs details on a public forum.

    Oops :)

If you have no fear, then you will have no problem in our solicitors requesting your IP details from MSE will you then as we will be passing the thread details onto our solicitors to follow this up on.
From what I remember, you can only get such information with a court order, not just on a solicitor's word.

I am also very concerned by what I have read in this thread up until this post - someone has stated their opinion, and has made it clear that they are doing just that, which are well within the rules of this site, and you are taking great offence with what they say.

I personally do not like it when a company starts threatening their lawyers as that makes them look like they want to throw their weight around and control others.

You are acting very hurt over someone expressing a (very clearly-marked) opinion, when you could have either ignored it or made a more measured response.

Just my 2p, take it for what you will :)

We will make only this comment to yourself that since you clearly retracted you previous comments in fear of making libellous and defamatory comments at the beginning of this thread - I would advise caution.

Why would you delete your posts if you believed every word you had wrote on this thread and were NOT in fear of being 'wrong' ?

You know what you have done - you reap what you sow.

    Look.....
I have posted FULL CLEAR LEGAL PROOF on 12 occasions that your website is not legally fit to sell.
I have directed you to a government website containing the regulations which your website must fully abide by.
You have not acted on this, therefore the law is being broken. Plain and simple.

In relation to the fear of 'being wrong': I deleted the posts in relation to possible copyright theft because you sound like the type who would take a baseball bat to my knees.......I want to keep my knees, thanks, so I have not mentioned anything to do with piracy/copyright since...
