    Your ignorance of legal matters is becoming laughable.

    Something which is true is not defamatory.

    Awards of compensation in any upheld civil case are related to the damages caused.

    If or when the thread is deleted, then it is patently not doing you any damage from that time onwards. Before that event, you've claimed increased sales, so no damage yet either.

    We can also report MSE for actually allowing libellous and malicious comments to remain unchecked so that 123Reg actively BLOCK any emails from the site.

    The problem is with reporting us to people - we will eventually be able to prosecute you after we do get orders to release information about complainants.. it can be done as posters above have said.

    So then, you and everyone else on this thread could legally prove with evidence, that we are doing something illegal in regards to the Sky cards or the backup service we offer to clients OWNING the item before using us?

    You have proof we 'tamper with the Sky cards' - which has been noted previously on this thread and you also have proof that we are pirates, who sell 'on carboots' and conduct illicit activities on the net?

    The thread will be deleted, it is coming and in a roundabout way, weirdly.. it is not YET affecting custom in a negative way.. probably due to people siding against idiots on this thread and actually 'trusting us' with their orders.

    I really do not know why people are carrying on with this thread, as any correspondence we get from 123Reg, Nominet, or the hosting, and MSE will be shown on this thread to validate us.

    MSE have sent us a good one we have to say as well... it is not from Martin 'surprise surprise' and does not carry a senders name (wonder why!) but blatantly accuses us of illegal activities- all the while, not giving their information.
    Would you like us to print this on here - our legal team have a copy and this has been included in the case and passed to the webhost as well for breach of MSE's terms and conditions

    They don't PM you mate.. they require information from MSE.
    If MSE don't grant the information, the team go for TheBunker.net who MAKE MSE disclose the information.

    That's the problem with hosting you see - when it is outside hosting.
    MSE may not play ball - but it is the hosting company who has the power.

    People seem to think this is the only way people are coming to the site- when this is clearly not the case.
    Word of mouth is the BEST form of advertising known to man.
    It costs nothing yet reaps the greatest rewards and the greatest client base.



    We are happy with the new influx this thread is giving to us - if the people coming to our site now ordering, believed any of the crap being posted on here.. do you really think that they would trust us?

    When it is closed, correct, there are avenues open to US as well - which we are on the way down now.

    'Andrea' for people who do not know is the kind soul - who ALLOWED us to post on here after:
    * Banning our previous attempts to reply - not giving us a reply.. also reported the hosting
    * Ignoring our emails to allow us onto the site - again, against MSE T&C's
    * We had to see a message on Google - Google !!!!!! to say we were allowed to post - without any contact from MSE staff... which again, has been reported.

    Andrea for you mate - is the kind person WHO HAS clarified we now have a voice on this forum and the one person we do not class as a forum 'chimp' - someone who has actually worked by the rules of this forum and done something not against its own T&C's.

    None of the other posters will explain this to you mate because that makes them look thick as this thread is continually descending to new lows - so it might as well be me who explains this to you fully.

    This site is good value for money, I'm glad I signed up now. Is it always as exciting as this?

    Did XLT say that the whois information posted regarding the .net was incorrect? I feel another complaint might be in the offing, Verisign require that whois information is current and accurate :confused:. I get an email every so often from them reminding me of this.

    Why do you think people have not reported this on other threads on other MODERATED forums around the net?
    WHY do you think this has remained primarily on here?

    Again, having sent a quite nice email to FACT in regards to our service and the UK law, I doubt that we would have any kind of trouble from them whatsoever. They know the law as well as we.

    The problem with this thread is, the amount of people clearly attacking a site they know
    a) Nothing about
    b) Do not use
    c) Are jumping in for as you have said 'the fun' of an argument

    Very problematic for MSE as:
    a) The users of this thread have no proof of any illegal activity on our site
    b) CANNOT prove anything on a)
    c) Are reporting us to (X) again, without proof
    d) Openly telling people NOT to use us

    All 4 points are defamatory and libellous - look it up.
    The point being, everything is geared towards making us look bad.. which is defamation.

    You have clearly jumped onto the thread to join in the attempted 'fun' (fun being a very choice word) against our site.

    Apart from this 'fun' has consequences.. and those are:
    a) the thread will be shut and deleted
    b) We WILL end up with your contact details and will sue IF our trade is affected negatively.

    B* Believe the posters if you will, MSE and TheBunker.net will end up disclosing your user details - legally they can, and legally they must.

    Do you really think that they will protect you and other posters on this thread when it comes down to it?

    Nominet clearly state as you well know, a site's details can be held by an individual OUTSIDE on the business when using a .co.uk

    All you have done is provided this forum with the details of our ex business partners home address .. the problem with that being, he has no ties to XL at all, nor is legally involved in it.

    Whereas having chased this up, he can clearly - and has - reported this site to its hosting because it has posted private details which have been opted out of because of him being an Individual.

    All you have done, is added more evidence to the case against this thread and allowed us more of an opening for Tim to personally sue you against the data protection act (not allowed to post private information on a public site without HIS consent, in writing which I belive, you do not have)

    MSE already have had a Cease and Desist in the post to them which will clearly kill the thread which I believe, that is the first thing required by law. TheBunker.net will also be getting a similar document should they not get back to us by close of business today in regards to this as well.

    We can then go from there on whether this nonsense continues.

    In defamation cases, you need to go for the site holding the information first - if this is not given, you then go for the hosting who WILL provide the details.

    In the case of the site holding the info not relinquishing the information at first opportunity, this aids the claim in court that MSE will have been negligible in not following their own terms and conditions.

    Which is why people are not joining our forum, only posting on un-moderated forums, and not attacking us on the broad spectrum of the net.. because they know, what they are doing is illegal and only MSE is their protection to hide behind.
