    You are selling backups copies quite openly. I am surprised FAST has not shut you down that's is probably why you dont provide any address.

    I am surprised MSE is allowing you to post because in my opinion your web site is unlawful and or your business is

    £3.50 for wii games backup you can get cheaper than £3.50 anyhow same with other backup which are illegal

    The people at the beginning of the thread expected no comeback on the posts they have made, hence my appearance on the forum.
    One has already - deleted his posts, the original poster will be having the thread deleted, and a few posters before have now.. lets say 'quitened down'

    People need to know that what you put on a forum can be punishable under UK law.. you must also remember that MSE will NOT withold your account details from a lawyer requesting them if needed to sue someone.
    However, maybe you would be kind enough to enlighten me about this. These 'sky' cards you have - and apologies if I get something wrong, Im sure you will correct me. They are £30 -£40 for 2-3months viewing?? Why would someone require/need one of these when as a Sky customer they already have one? Genuine question as Im a Sky customer and have been for years and years, and I have never had to do anything with my card until recently when I was sent a new one. So Im unsure what the purpose of yours are.

    Exactly - if you have a Sky card, why would you want one?
    Most of our customers I believe are not account holders with Sky - but would like the FreeSAT from Sky package.
    Just to confirm, XL Trading does have the right to reply but this does not mean MSE endorses its products in any way and, like all other forum users, must help us keep the forum a friendly place to be.

    You are funny XL and this thread has shown you to be out of your depth.

    You threaten forum members and the website with your wikipedia lawyers.

    You get your accounting advice from the FAQ of PayPal and google checkout.

    EU legislation does not apply to you as you are an 'individual'.

    I have no need or reason to pretend to be anyone other than who I am and I cannot help the fact that I run a very succesful tax practice in two countries and know tax law across Europe inside and out.

    If you want to learn something and protect your business, then learn something from this thread and ensure your website is compliant and that your tax affairs are in order.

    You make reference to you only 'offering our time and service' is that your way of proving you are not trading?. That is funny, again, as a professional perhaps I can get away with just 'providing' my time and knowledge and thus not pay any taxes.:rotfl:

    Still you mention your cards are legit, and once again, I don't care about your wares, but I do care about a business that is breaking several laws and threatens fellow posters with libel.

    If you feel the need to respond to me, go ahead, but respond to MY posts, there's no need to bring other stuff in about legit cards or not as I'm not interested in that, I'm just interested in your apparent knowledge of law and accountancy.

    As an aside, as any good libel lawyer would tell you (Carter Ruck perhaps), you don't threaten the person you are about to sue as it jeapordises any level of compensation expected and allows the defendant scope to aim for a fair comment defence and so by repeatedly goading members to respond to your posts you'll find you are damaging your own case against others.

    Thats rich coming for a pirate web site openly selling pirated games/dvd @ inflated prices etc plus not complying with EU trading laws.

    Defamation is a catch all phrase that covers both libel (the written word) and slander (verbal) - You cannot sue someone for both Defamation and Libel - it is either libel or slander or both, but not defamation. If you're going to give a faux lesson in law, then at least get it right.

    We do have proof that your website is illegal as several people have pointed out the laws that apply to you. Sue away, but the easiest defence to a libel action is to show that the statements made are true - which they are.

    Accusations of piracy are difficult to prove - both by a poster but equally by the website, what evidence does it have that the customer has an original copy?. Without checking, the website is not taking reasonable care in it's activities and leaves it exposed to attack from Nintendo/Sony, etc. Sony closed down Lik Sang a few years back, CD-WOW was kicked into touch, MS make it clear that modded consoles are not welcome and I recall Nintendo also succeeded in getting a mod chip banned in Europe - so a very grey area and one which would open a whole can of worms should one choose to go to court to avail of a libel action.

    I wonder what other fraudulent things you do, they do say piracy encourages other crimes, like benefit fraud, drugs etc etc. Not my view just what they say on tv

    Couple years back a backup outfit in Liverpool was busted for piracy and benefit fraud, they said that the only people can do this is have plenty of time on there hands hence benefits etc. Provided backups is illegal. So you provide a nice dvd case, dvd-r for around 50-80p tops nice clear profit of £2.70 maybe less postage

  • If you have no fear, then you will have no problem in our solicitors requesting your IP details from MSE will you then as we will be passing the thread details onto our solicitors to follow this up on.

    This thread is basically an attempt to gain negative press about our service and site as a whole. And as such, you will all not mind then that we can start legal proceedings against:

    a) this site
    b) users posting such libellous comments when they have no factual evidence to hand


    Well at least those posters will finally be able to get your geographic address - from the court papers you serve on them :) You will share it, won't you people?

  • This is the problem - people DO NOT know how and what we do at XL in regards to the Sky cards.. they just assume we get them illegally, and of course, being the net - have 'just got to post' about it.

    You actually do not have the right to post a comment saying 'I advise anyone not to give your company a single penny!' - again - you are not a client of ours, so you are posting a defamatory comment about a site to ruin its reputation.
    As a Sky subscriber who has to pay Sky for any Box office purchases, when I see someone offering a way for people to purchase these box office movies etc without paying for them, I have every right to advise people not to use such a company.
    No loophole exists mate. We get them legally from Sky.
    The mere fact that this item is our most purchased - and sought - after product on the store indicates, people do not care what you think and will make their own minds up.
    Fair enough, I am sending a letter to the top bods at Sky asking them for confirmation that it's fine for me to cancel my subscription (am out of contract) and instead use your card.

    I will also confirm with them that's it's 100% legal to order any box office event with this card without paying a single penny (as you advertise on your web site)

    If they come back and say that it is fine, then I will humbly apologise to you and you will get my custom for life.
    What customers do with them - is upto them but they MUST use them in accordance with the T&C's on the site.
    Just had a quick look at your site and the terms and conditions for using this card weren't in any obvious place?

    Clicking on your terms and conditions give me terms for DVD's, 360's, music CD's, Nintendo, PC and Sony, but I cant see Sky mentioned there?
    We sell something people want - and the problem is?
    I want quality programs to be made and purchased. The more people that use your service, the less money Sky have to invest.

    Yep, you can. But just because something isn't illegal doesn't mean it's right.

    You actually have no legal right to say 'avoid this company' because you do not know us, you have not bought from us, and you have purposely used posts in this thread to basically pull our reputation to bits... which is defamation mate any way you wish to play it.
    I have every legal right. I have not once said you are doing anything illegal. I have said that people purchasing through you are denying Sky investment money, hence I will advise people to avoid your company (and any others) for the purchase of Sky cards and I have every right to advise people of that.
    Martin Lewis is always giving us advice on how to force companies to do things.

    How about giving us advice on how to remove ourselves from any part of
