    Perhaps someone will be close enough to relevant bank/court sometime to give it a go, perhaps in a situation where enough money is involved to make it worthwhile.

    The other major problem to enforcing this way is that from all the evidence, this doesn't now seem a cash rich operation.

    If we were able to look at their bank account, chances are it is operating permanently in overdraft!

    Yep, blood out of stone etc.

    Love to look at their bank account, along with various other similar organisations.

    Not too sure bank would be keen to pay out on a CCJ on an overdrawn account even within agreed limit!! Funny idea overdraft limit might be reduced pdq, prior to enforcement maybe. Can't say i could blame the bank in this event.

    had mediation today, at least they are still about to do this, you would think if they were going in to liquidation they would not bother to mediation? or am i just wishful thinking? they accepted they owe me the full amount and asked for 31st july to pay, which i rejected. I put something to them and they said they had to ask their financial advisor. I will hear back thurs. Im hoping they agree as i would prefer not to pay out for court, but am prepared to do that. of course there is no way of guarenteeing my money at all.

    I had to issue legal proceedings to receive some/all of my cashback
    Has anyone actualy got any payments out of these in court recently, just wondered if its a waste of time taking a day off to go to court, when the court wont enforce payment even when you win. It all looks like a waste of time if no money gets returned to you at the end of it all, particularly if the ballifs cant locate them either!! Are they turning up at court?
    Nicole-What is the financial settlement you asked of them and have they agreed?
    Any help appreciated, because I have sent my forms off to attend court, but at this moment in time it appears it will be a waste of money and time.

    I think we're wasting our time chasing msols. It is clear that they have always had a business model based on not paying cashback. Also their terms and conditions fail the Unfair Terms legislation several times over.

    Since 3 have renewed the contract with msols despite the contracts never having improved I think chasing 3 is the better options. They could likely be held culpable as they have pushed this very bsuiness model - and their actions certainly support it.

    I suggest some kind of either class action or similar type complaint to Ofcom. I think it likely msols will cease trading soon. There is possibly enough intent in their actions to go for a fraud conviction. That could be the second aim.

    Go for 3 they started the whole thing.

    thanks for the advice...i am filling in the N225 form now...will it make a difference if i put a specified date for the money to be paid or will it make matetrs worse/better for my case?

    Just tick the box that says you don't accept their proposal for payment, then say you want immediate payment, bearing in mind the length of time you have waited. Also tick the box for immediate payment.

    This won't go against you in any way. Should the court decide to allow them time to pay, then you still have won the judgement, but must wait to see if they comply before starting enforcement.

    If you originally claimed interest, you can now claim the extra that has accrued since the date your claim was issued.

    I am in the same position myself. I have just posted off the N225 today so i will let everyone know how it goes.

    Amazingly they have already admitted that they owe me the money but in their defence stated that due to problems recieving payment off one of their networks they were unbale to pay me until the 23rd June 2008.

    Can you believe that!
