  • I had to issue legal proceedings to receive some/all of my cashback
    I'm not sure now... It would be an additional £55, on top of the £130 they owe me already. Henry/Quentin- if I understand the latest developments correctly then all warrants are unlikely to be successful as they'll be directed to an address where there are now no assets to seize?

    I used the address below from their website - this is the only address I have ever seen, I am unsure if it is their registered address

    High Street, Watford
    Hertfordshire
    WD17 1NS
    just to reiterate - they did pay one of the warrants but not the other, so there is always a chance and I only paid an extra £35 for the warrant (which was on top of the original £25)

    Yes that is their registered office address - apparently they "occupy" room 11 at Parade House. Hopefully someone will be able to locate their whereabouts and share the info here.

    The £55 needed for a warrant does look a bit of a gamble - maybe worth waiting to hear if henryboy's cheque comes (indicating that the one payment the bailiff did get hasn't bounced), and whether or not the bailiff gets anywhere on his second warrant.

    I might be a bit out of date here but what is wrong with the facility provided by mcol to order the companies bank to pay cash due under judgements? 'Garnishee order' i think. Presumably someone has their bank details?

    As i say i might be out of date and missing something plus of course they might have a 'virtual' bank account as well!

    They are now called "third party debt orders".

    The problems with these are:

    You need to provide the third party details (ie the bank accout details)

    They still cost £55

    You can only try with it on one occasion (so if you apply it to the Bank, and the account is empty on the day you select, then even if £1million is in the account the next day, your order has failed). (At least when paying for an order for the bailiff they will keep trying.)

    You have to attend a hearing (if the order has been successful, and frozen the money in the bank account) to actually get the money released. This can be at either the defendants local court or the third party's (ie the Bank's).

    So all in all probably not worth all the hassle.

    hi...

    i had claimed money through MCOL first week of April and heard from MR today...they have admitted that they owe me the full amount of £580 without the interest. they have asked to pay only on the 4th of July...

    please advise on how i should proceed wth this case...

    You need to decide whether or not you want to spend any more on this.

    If you are prepared to pursue the matter by rejecting their offer, which in normal circumstances would be the obvious thing to do - as if you continued the action you would win, get all your interest up to the date of the judgement, and you could ask for immediate payment.

    The concern is that they might be in a "can't pay" situation now, bearing in mind the recent posts regarding the bailiff's feedback.

    If that is the true situation, paying for a hearing and then paying to enforce the judgement may be more money down the drain.
