    Irrespective of delivery and the passing of risk in the Equipment, or any other provision of these conditions, the ownership of the
    Equipment shall not pass to you until (i) we have received in cash or cleared funds payment in full for the price of the Equipment and
    all other Equipment agreed to be sold by us to you for which payment is then due and (ii) you have made all payments due under your
    Airtime Contract for the Minimum Period, if you acquired your Mobile Phone/Smart Phone on the basis that you enter into a Airtime
    Contract.

    this is a bit of an issue for you then.

    surely under section (i) the full price for the piece of equpiment could only be the price you have it advertised at,in many cases free.

    and under section (ii) the airtime contract as it was was entered into without any dispute,but,orange have not stuck to that contract so through no fault of there own the contract has effectively been voided by orange.

    i would say if someone did not accept these new terms and conditions as they are entitled to do then your issue would be with orange and not the person you sold the origonal contract to.

    also people being given a discount are not changing priceplan they are being given an extra discount,again this couldnt be seen as changing tarrif,surely.

    if you stick to your guns regaring the above and fail to see sense it looks like a shewd move by orange in the fact that in future people will just go direct to them without the hastle of having to work to two sets of terms and conditions.

    Hello guys,

    I'm outside UK at the moment, and will be back in early September, will I still be able to cancel my contract? Can I even cancel my contract after 14th of September? And by the way, orange has my 150 quid deposit, hope they will return it too :)

    I suggest you push it - because clients only have 30 days from being aware of the price change to cancel the contract.

    Surely if all your customers turn around now and return your phones - knackered, scratched and worthless - you will lose on this as well. Not mentioning that your reputation is already very thin thanks to this. You sold your customers product which has now changed and is going to cost them dearly.
  • I contacted mobiles.co.uk a couple of days ago and asked them if I would be in breach of their T&C if i negotiated a reduction IN THE COST OF MY TARIFF. This is their reply:

    Hello,

    Thank you for your email.

    It is at the discretion of the network provider to reduce your tariff
    therefore you are not in breach of anything.

    If Orange have authorised this, our terms and conditions are
    irrelevant as we are simply the service introducer.

    I hope this clarifies your queries.

    but the terms and conditions have been changed,you cant have terms and conditions and say the alteration of some has no bearing on the contract as a whole,orange have held there hands up to this and its costing them,if someone was to take the terms and conditions you posted above and argued it i cant see how you have a leg to stand on.

    One question I have.

    Some of the tariffs on offer from yourself are at a discount. So I am paying £30 a month for Dolphin 40, when usually it would be £40 a month.

    If I contact orange and get a discount (say £5), would that be off what I'm paying now (so would be £25 a month), or would it be off the full dolphin 40 price (and so I would end up paying £35 a month)? Thanks.

    Note that this doesn't refer to discounted line rental, which is only payable if the customer remains on the same tariff.
