I rang up yesterday and PAC on the way.... just got to find a good replacement now!
I'm not with Orange, but the info on the Bitter wallet site is very helpful. Especially love all the parts that they say are boll ocks :rotfl::rotfl::rotfl:

Come on, how can they prove it was only because you knew about the price change? You can phone any 0845 number under the sun, then Orange won't have a leg to stand on. Make sure you request a PAC number before you cancel, however.
Because of the date I received the text

This will echo other people's responses no doubt but just wanted to let you know about my experience.

Just had a call back from a customer service manager who said that as the new changes have not been to my detriment so far, Orange do not believe I have a right to cancel the contract because of a breach of contract.

I asked if this was the final word from Orange and he said it was, and that my only option was to consider contacting Ofcom.

They did offer me a paltry amount (with the proviso that I wouldn't take this any further) but it wasn't an amount worth considering.

I personally reckon Ofcom will agree with Orange and not allow people to cancel their contract unless the new charges have been to their detriment.

Here's hoping Martin Lewis raises the profile of this! :money:
    From the Bitter Wallet site

[QUOTE]You’re told the changes won’t effect you because you don’t currently exceed your monthly allowance of minutes
It doesn’t matter whether you currently exceed your allowance or not, because the contract you agreed with Orange doesn’t consider changes causing material detriment to you - i.e. whether it will increase your average bill. What your Orange contract actually says is:
4.3 You may also terminate your Contract if we vary its terms, resulting in an excessive increase in the Charges or changes that alter your rights under this Contract to your detriment.
In other words, it is your right to go over your allowance of minutes without paying more than you previously agreed to. Like voting and free speech, whether you choose to exercise this right is up to you, but Orange have agreed they cannot make changes that affect your rights without your agreement.
    Action to take
Tell the operator that while you may not currently exceed your allowance, it’s your right to do so, and that this is clearly stated in your Orange contract. Read the clause to the operator if you need to.
“Just cancelled my contact with 13months to go. no fees. operator did try the “but you don’t use all your allowance so it doesn’t effect you.” I gave the stock reply of “but i might want to go over my allowance in the future.” Her reply was “No problem, when would you like the contact to finish?” Result and I get to keep the phone.” Ed-209

  • I was coming on to post that Bitter Wallet link :) It's very helpful and there are customers on there who have been very persistent and quoted the relevant clauses to them and they have been able to cancel despite not being eligible; the clause does not state anything about the previous 3 mths usage etc so it applies to all customers who took out a contract prior to June 09. I'm waiting on Orange replying to my email and will try again.

Not directly (ie orange contract to orange contract)

But you could do it by porting to (eg) o2 payg, then requesting a pac from o2 and using it for a new orange contract.

Humm o2 payg where you can use the PAC code has 1month contract. Any tariffs that give sim only payg tariffs where i can use my PAC code and get one back to go to orange?

The changes also affect June 09 and July 09 contracts

I take it that if i dont request a PAC the termination of the contract is instant when they disconnect the phone ?
  • I just tried to cancel, having been refused yesterday. They flatly refused today because I haven't called any 08 numbers and don't go over my limits. Explained that it doesn't matter, but also added I will no longer be using my work phone and I may use my contract differently during its remaining 3 months. They refused, I asked to speak to a manager, told no-one was available and they "released the call".

Guess I will wait to hear what Ofcom are saying tomorrow before I try again.

Just got off the phone to them again and I got put through to the manager who offered to provide me to a website which converts 0845 and 0870 to local numbers. I outright refused and told them I'm not accepting the news terms and would call back later.

Heh... good luck with that... :rotfl:
