Make sure your original order ID on return address label. I sent my 'sample' back unopened by signed for (ie traceable) Royal Mail Post just this am (used a smaller jiffy bag - cuts cost - was approx 1.50) It took Dazzlewhite almost a fortnight to ship it to me, so I ain't worrying about a fastrack return. Besides, they no longer have access to my bank account (I've got a new account number and debit card with TSB - they turned out to be most helpful)

Good luck guys. Just see these shysters off and warn lots of other people of the game they play :T

    Hope this is useful?
  • Like a lot of you I was caught out in this scam. I sent the product back within 30 days and have proof that it was received and signed for. Has anyone been successful in getting a refund and how long did it take to go back into your account?

Saw the title and thought I would post to give an insight from the card companies side and how I/we have been dealing with these payments as they are a F***ing nightmare.

Trial terms state its anongoing payment if not cancelled within 15 days, if you dont to this your going to get billed the initial £3 or so and the full £56 or w/e they are currently being billed, just because you didnt read the terms doesnt mean they dont apply.

I have tried all sorts to chargeback these payments, Goods not recieved, cancelled CPA, transaction not recognised,

The merchant continue to charge your account after you have contacted them to cancel, all these small amounts ezykit, healthmember, vh access etc etc. If you provide your bank with the cancellation date they can chargeback any/all of these payments after this date.

Good thing is I think with the merchant being a scam they arent representing any of the chargebacks( disputing what cardholder is saying).

The fact that you have returned the goods to the merchant does not ]= you getting a refund back from the credit card company even if you have proof, mastercard/visa regulations is what have to be followed, you need something in writing from the merchant confirming they are "accepting the goods back from you and will refund you". I speak to what 10 people a day at least with this scam, whitecleanse, natureberry, acaiburn, etc etc. I hope most of you get your money back..

At the end of the day these pills/teethwhitening stuff its all garbage from what most people tell me.

    All the best.

There must be laws about clear disclosure and not hiding fundamental aspects of the contract in the terms and conditions. In the US the Federal Trade Commission (FTC) has laws against this and I would guess that we have something similar here too?

There are also the distance selling regulations (right to cancel) - found this info from a comment in another blog post:

“3.1 You must give your consumers certain information before they agree to buy from you. We refer to this as pre-contractual information which includes the following.
    (i) Your identity including sufficient detail for the consumer to be able to identify the business they are dealing with.
(ii) A description of the main characteristics of the goods or services you are offering.
(iii) The price of the goods or services you are offering, including all taxes.
(iv) Details of any delivery costs.
    (v) Details of how payments can be made.
(vi) If payment is required in advance, you must supply your full geographic address 11.
(vii) The arrangements for delivery or performance of the service, for example when consumers can expect delivery of the goods or the service to start. “

Of course the head office of the company behind these scams being in Canada complicates things but they were at one stage using a UK Ltd company name and address (Gillmap Ltd, County Durham). That company is still registered with companies house as trading at that address.

Yes Im aware of your normal protection, however these dont apply to visa mastercard regualtions. I mean feel free to pursue this company/companies via any avenue you feel necessary, just trying to get over what can/cant be done thats all mate.

We have to work within each scheme, for a chargeback to stick if you like. Like i said the fact you send goods back doesnt mean the card company can chargeback the payment to them cause they didnt get a refund........

I speak to people daily regarding this, some claim didnt sign up for anything and the merchant comes back with their personal details, others advise they signed up for trial and didnt read the terms and conditions, etc etc. Good news in Mastercard/Visa have been made aware of the merchants actions so hopefully they can take steps to shut these guys down,

I would hate to be their merchant bank they must get about 1000 chargebacks a day.

Just a point about disclosure of their terms, on some of the sites, its posted right on the main page, you cant miss it and is perfectly clear what is going to happen, Others you HAVE to click you have read the terms and conditions before you can proceed, There is from my own POV clear disclosure of how things will pan out. Thats my opinion thou, from information I have seen from cardholders, it would seem trading standards are already on the case from this end, but at the end of the day i think they said and dont quote me, they cant stop people signing up to these companies and not reading the terms and conditions. Something along those lines..

I hate these guys I really do, like i said im glad its been posted on here hopefully people will see this befrore they get the idea to sign up. It would save them a lot of time/money/grief.

    Keep up the good work:D
  • Thanks for posting and clarifying - it's interesting to get your perspective on this.

No problems, As said before im with anyone thats caught up with these guys and do my upmost, but a lot of the time there isnt a chargeback available and some people gotta take the payments on the chin so to speak.

Suppose the bottom line is any trial your signing up for - Will 99 times out of 100 will revert to a month billing if not cancelled. Dont assume that cause you aint using/recieving/wanted/wanting/going to ever use etc it makes no difference:(

    Anyways all the best
