I am too having a problem with this company. I placed an order with them for approximately £800's of goods on line 3/11/10. I then got a letter etc and was asked to ring them to confirm the order which I did but was not able to get through to them so I emailed them and asked them to phone which they did. I was then informed that my goods were not in stock and would be at least 3 weeks, also the letter informed me that the delivery would only be to the door of the property, great I live on the first floor, when I mentioned this they said it was on their website but I didn't find it when I looked at the T&C's before I placed my on-line order. I haven't heard from them since and for the last 2 days have been trying to contact them. I have emailed them 4 times and have spent 5 hours on the phone using 3 phones to ring the 3 phone numbers no response from the after sales numbers, I did, after 3 hours with the ringing tone, speak to someone on the sales number who said that someone from after sales would contact me..I'm still waiting!!! Oh and I forgot to mention when I did finally speak to the girl I mentioned that I had been hanging on (paying for the call) for 8 minutes for her to answer..her reply "oh that's good then and giggled!)
If I ever get to speak to someone I am going to ask for our money back and go elsewhere, I would not recommend using this company to my worst enemy. Ali0 -
Well done,perhaps money talks,and Jual are reading these threads-and some person with sense within the company realises the damage this bad PR is doing them.Well,they need to get with the 21st century or die.
I think it is more likely my tactic to send official letter befoe action plus draft of a court Claim Form - i.e. a real Court Form more or less properly filled in but not yet officially stamped by the Court.
They know that of those who threatern to sue only about 1% will actually do. By actually sending a draft claim form it shows that I know the procedure and they probably realised (correctly) that they would get sued if they did not meet my reasonable demands.

It is generally easy to complete as on a claim form generally just facts are included rather then detailed legal arguements. So you don't really need to do detailed research and include relevant sections of legislation etc. A number of solicitors told me that I should not include legal arguements at all on a claim form - just the facts - but I think it helps to convince the other party if you at least refer to relevant legal concept (i.e. in my case where the goods delvered are faulty that being a breach of a condition of a contract giving the right for me to choose one of the following: repair / exchange / refund under the Sale of Goods Act)
In my letter / draft claim I did not even bother to argue the fallacy of the telephone-chap's arguement that connecting the machine means that I can not reject it. (The law states that if you do something that is incompartible with the seller still owning the item then you can not reject it. So it covers things such as major alterations and most certainly not just connecting an appliance. If I painted it or drilled holes to install it then I might have lost the right to reject and claim a refund. Merely unpacking, or plugging things in, or trying to use the item does not result in a loss of right to reject it turns out to be faulty.)0 -

By all means do try to speak to a person to confirm arrange cancellation (and preferably record the call).
However given that getting to them might requie several attempts there is no harm in sending email/fax asap with a brief request to cancel.
Under distance selling regulations there is even the right to cancel within 7 days of receiving goods - but then the consumer might bear the cost of sending goods back or the cost of business collecting them. Arguably even if the goods aleady on the companies van they consumer should be bale to cancel without any losses as it does not cost much for the company to take the goods back instead of delivering them.
Also noticed that a number of directors resigned very recently and new ones have been appointed. It could mean lots of different things - in particular it could mean a change of ownership. Change of ownership again could either be a good thing or a bad thing or a neutral thing. However provided you paid by credit card (and sorry but if you use a debit card over the internet to buy goods - it is a foolish thing to do) it should not result in major problems whatever the reason for that because then in the worst case scenario credit card company will step in.0 -
Scrudge, my experience is that a Visa Debit card has the same protection as a credit card. Rather than calling people fools to use debit cards you might offer appropriate advice instead?0

While in your experience it might have been the case I prefer to have more clearly defined rights that I can enforce in courts.

Chargeback is nowhere near as strong as Section 75. So those of us relying on our Visa cards might not be such fools after all.0 -

I can not argue against the sometimes bit. Who knows - may be some little known bank somewhere offers 10 year warranty on their debit card transactions.
However the general rule is still credit better then debit because:
1. Have statutory protection - no reliance on contractual / goodwill gestures that are subject to change and differ between issueers.
2. On credit cards generally can have all the prtection of debi cards plus more protection enshrined in law. If you like Visa chargeback protection cann get a VISA Credit card! But Mastercard/Amex also have a chargeback!
3. In case of major fraud when account is drained it is a lot easy to recover from credit card then debit card. If my credit card account is raided it is not my money anyway and all it means I won't be able to use the card for a couple of weeks / month. So back to cash basically. If debit card account gets raided - chances are it is the main bank account - then all bills (including credit card) might not be paid. No quick access to cash - BIG PROBLEMS!!!!!0 -
Scrudge and everyone finally got a phone call on Friday morning to say that they had one of my items, another was no longer made (would I like and alternative?) and the other 2 items might be available in fourteen days. I said as I was on my way to work couldn't agree to alternative without seeing it so asked if it was possible to have my money back? The girl was very pleasant and said yes they would refund my money and it should go back into my bank between 3-7 days. I have had a confirmation email, so have just now have to wait!!
We have got same or similar items from Sainsbury's and Dixon's be with me Thursday and next Saturday will bring into the flat. :T Cost about £40 more.

still no contact with these goons.
im gonna fax them from work tomorrow in an attempt to get them to ring me back,other than that not much i can do.
have contacted Visa and they have said that they cant do anything til 30 days has passed,was hoping they could shake them up a bit with a fraud enquiry or something.
its a bit of a crusade for me now and ill get there in the end!!:D0
