    thank you all for your kind words.

    Me brave? I would like to think htat in my case "Discretion has been the better part of valour", but really I think I am just a bit weak! But thank you all anyway!

    I don't think stbX is moving out tomorrow. I think he plans to stay on a week.. (This I gather from what the kids and my Mum have been told). It is a right cheek. He has not even asked me if it is OK. I did email my solicitor to check the terms of the transfer, but she has not got back to me. I was not able to ring her today, as I was at an all day business meeting in London. Did not get back until 7pm.

    Also, I saw his ebay page, which he left open, and he has spent over £1000 in the last 60 days!:eek: OK, he has bought a £99 suite for his new gaff, but really! A lot of old photos, cigerette lighters etc. What an idiot.

    It makes me especially peeved,beause on his Afferdavit, he wrote that he was not prepared to pay the court costs as he is unemployed! Solcitor has written to me and says we can either just apply anyway, and she will point out that he is to recieve over £80K lump sum, or we can leave it, and I will pick up the cost (about £350), Not sure which way to go.

    He would be locked in! He rarely leaves the house. Only to the corner shop to uy cigarrettes. We'd have to be quick!

    First thing tomorrow call your solicitor. His not leaving on the handover date could give him some form of right to remain or squatters rights or something, and if he has the money you dont really have any way to force him out.

    Thanks for the replies

    Well, I came back into the office this morning (was offsite all day yesterday) and there were a couple of emails from solicitor. They have heard from stbX’s solicitor to say that they are not completing for another week.I don’t really understand why this has only come to light now. It is obvious to me that stbX knew, from what he said to kids etc. Do these solicitors not speak to each other?

    I will ring later this morning, to find out what is going on. I have got a consultant with me all day today, so it may be difficult.

    I am in a bit of a panic now, as OLD mortgage is due to go out on the 1st, and because I thought I was redeeming that mortgage today, I have not put any money into that bank account! It is an internet only account, with no High Street presence. I think my only option is to transfer some money from my ISA, which is with the same bank. So, I will lose some tax free savings!

    I do sort of agree with just paying the Court fees so that I can get it over with, but then I also think that stbX is just getting away with everything. He just does what he likes. Doesn’t seem fair really.

    Hi all

    Just a quick update.

    Got home today, and OH asked me if I had spoken to Solicitor lately. He was complaining because (in his words) he cannot get the money until he is out of the house.

    I said, well the transfer is linked to the competion on your property. He said "So I have to get out in order to get the money?" He seemed really miffed about it. I just said, that is the way it works.

    I can't believe he thinks it is OK for me to buy his share of the house, and then he just stays until he is good and ready to vacate. As if I have not carried him far enough.

    He still acts like he is so hard done by. Really, I think I have been more than reasonable.

    So,5th Feb it is then.
