Envirofone damaged phone?

I sent this bunch a HTC Desire that was in pristine condition (even in it original box with accessories).
They received it, and reported that it was cracked and chipped, and offered me less than 50% of the original price.
I refused, and asked for the phone to be returned, which they duly did (without the original box and accessories), and there is no crack or chipping!
Sent to Asda, and got full payment!
I would recommend that you steer clear of Envirophone.0 -
I thought I would update the scandal at this moment, they have now started to ignore my emails, i sent them a breech of contract letter earlier in the week.
They started asking me to prove which phone it was by giving them the imei number which i dont have on record, but i do have the receipt for the special delivery i sent, they are saying i need to give them the imei number in order to proceed.
so 2+ months later, no phone, no money and no correspondence, it looks like i will have to go to small claims court???0 -
To be honest I am surprised that a TV consumer programme hasnt bought 4 new phones and sent them in with the box opened pre and see what they are offered0

its looking like i will have to go to small claims court, they are just totally ignoring me now, they have basically stolen my phone, any suggestions anyone?
ive put a letter in writing giving them 7 days breech of contract as was advised and it has been ignored also0 -

State the problem succinctly.
Tell them what you expect to happen... e.g. send you £xxx.xx. or whatever.
Tell them when you expect this to happen... e.g. within 14 days.
Tell them what will happen if they don't do this... you will start court action to recover your money.
Send it recorded delivery.
Google letter before action for many samples if you like.
Have a look at Money Claim Online while you are waiting for a response.
It might also be worth reading MSE's How to Complain article and their Consumer Rights article0 -
ok i have done this, they did ring me last thurs the day before i sent it, assuring me it would be resolved that day, but they never rang back again and never resolved. I sent the letter on the Friday giving 14 days so i guess i have till a week on Monday to wait before taking action, I listed that i wanted my 2 x special deliveries + the recorded mail costs + the price they already offered me. I detailed the evidence i would be using, copies of emails from certain people, screen shots of my account on their site + receipts of special deliveries i had sent to them and their confirmations + signatures from RM site. Just used one of the layouts i found online.
thanks for the advice0 -
just thought I would keep this thread going with whats going on.
Was just called up by 3rd person claiming 'wanting to resolve' situation, quite aggressive tone after a few words stating im 'living on another planet' if i think i am going to get it resolved as i have asked for it, told me to be lucky and hung up, they dont open phones apparently and it hasn't been touched, so they are saying it broke itself they didn't butcher the screws and somehow, somewhere it got a broken screen during the process, acquired all the fluff and hair between the lcd and the glass...
the most unprofessional bunch of cranks I've ever come across
it must have been like going to a truce to surrender....with a gun!0 -
i have just been through the money claim online, an extra £25 on top + not even offered to provide much of the evidence, apart from a summary of words which was missed off the actual claim they provided me with afterwards...not much hope for justice here i guess0

If you don't present your case at its best, then you won't achieve the result you are looking for.0 -
Hi, there is no option to present your case you can have around few characters for a summary that's it, no documents no explanations no anything, thought I would try it out as it was recommended but it didn't seem much use
