    Update.

    Rang Themobs.com - aka Mobile Solutions/Directphonewarehouse/threefones.co.uk/etc. - and they refused to give me a returns number unless I agreed to pay £30 - because I had opened the box!

    Googled 'distance selling regulations' and found Consumer Direct (highly recommended - just google!) I rang them - they even give you a 01 number as well as the 0845 number - and got the following advice.....

    Under The Distance Selling Regs. Themobs have to collect the goods and 'restore' my position to as it was before I entered into the contract.

    I was told not to send the phone back because "they could just lose it" but to send a recorded letter, told me exactly what to write, and they gave me the 'real' address not the PO box address I had!

    Just for peace of mind I called Three to make sure that I had cancelled the contract with them when I called last week. After a long call (thank you https://www.saynoto0870.com !!) Three are going to collect the phone.

    When I asked if Three (Hutchinson) are connected to Themobs.com (etc) I didn't get an answer! Read into that what you will.

    Havn't been able to speak to Consumer Direct to ask further advice as yet but will be doing so before I send the phone to Three.

    Bottom line - don't deal with Themobs.com or any of the names they trade under.

    Update 2.

    Spoken to Consumer Direct.

    Told not to send phone back to Three but wait for TheMobs to reply to letter. Allow 7-10 days. You have cancelled the contract so don't worry.

    As I said before I would recommend Consumer Direct, very simple, down to earth advice. At least thats one Government dept. that I can recommend!

  • Just a quick word of warning about themobs.com.

    There are a number of us who have failed or are still trying to get cash back from them despite sticking rigidly to t & Cs. Have resorted to writing to the Directors and contacting Trading Standards and I for one am still waiting for redemption payments four months later!

    You are unfortunately one of many, many people who have been a victim of themobs.com underhand practice. You will be charged in the area of £30 for returning your phone. According to themobs.com, this is a reasonable administration fee.

    Got a letter from The Mobs yesterday in response to my letter.

    They have just ignored the Distance Selling Regs. and repeated the T&Cs !

    I will speak to Consumer Direct asap and find out what they recommend.

    Interestingly I haven't heard anything from Three, who said they would collect the phone (see earlier post).

    Consumer Direct are going to refeer it to Trading Standard for "criminal proccedings".
    TS are going to contact me for more info/evidence.

    Hi again,
    TS rang me yesterday - sorry for the delay in posting!
    Problem could be that I didn't 'buy' the phone, so the distance selling regs may not count.
    But did I 'buy' a service? ie the airtime contract with Three.
    The lady I spoke to was very helpful and if she didn't know something she said so - "I'm not sure so I'll get more information and get back to you" - or words to that effect, - asked for copies of the paperwork I have and the original email.
    She was very interested in the selling email that I responded to - could be mis-selling or something like that.
    Will update as soon as I have more.

  • Received an offer from Mobs.com of phone for £2.99 a month package includes 400 mins plus 250 texts. It is one of these pay £35 a month and then claim the money back. Does anyone have any experience of this company - particularly have you got your money back?

    Sorry if this is in the wrong place - never started a thread before!
