    My letter to street registry Leeds...

    I am writing to enquire about Shire Oak street situated in Headingley, Leeds. On the 28/4/09 I parked on this street where there were no double yellow lines or signs to show that the road was privately owned. I returned to my car 10 minutes later to find a private parking ticket issued by UKCPS Ltd with a charge of £75. There are signs at the bottom of the road stating that it is private however this is obvious as there are marked out parking bays and car parks. However the road I assumed was public, and seeing there was no double yellows I parked there along with around 15 other cars who had no evidence of parking permits. My car and one other car was targeted but the others were not. I was parked (as you stand at the bottom of the road looking up)
    on the right hand side, next to some bushes below the old BT car park. There was no reason for me to believe that I was parking on private land as I was not in a car park or in a parking bay or had seen a sign saying this is private land. Please could you help clarify this for me as I wish to take action against this company for misleading people. On your website it says that the road has split status from Otley Road to the Back Shire Oak Street (Western Corner) being Public and the Back Shire Oak Street (Western Corner) to 'End' being private. This may seem trivial but I would like to know if I was in fact parked on private or public land. It could be that UKCPS Ltd are issuing tickets on land owned publicly or are misleading people into parking on this land unknowingly it is privately owned, in both cases seem to me as fraud.

    You mention signs saying the land was private.

    Were there any signs laying out parking terms and the implications of contravening those conventions?

    yes the terms were posted next to the parking bays at the bottom of the street, so i assumed that it was meant for the parking bays there, not for the unmarked road at the top

    This happened to me in exactly the same place on Tuesday as well .... not only is the area not marked but the time on my ticket said 15:15 ... I didn't even park there until 15:45 and I was there for five minutes and got a ticket in that time. There were plenty of cars all down the street and none of them got tickets. I don't want to send them an appeal with a cheque as I feel it will be a waste of time as they will cash it an ignore the appeal. However if I am going to appeal I need to send the letter by tomorrow really as otherwise it will not arrive in time. My cousin who is a lawyer said to go to the C.A.B but again this isn't open until Monday and that is a little late. I have feel I have been round in circles trying to get advice on what to do in this situation as I really don't want to pay for something I didn't do.

    1) Don't appeal - waste of time with PPCs, and it saves them the expense of getting the details from the DVLA.
    2) Don't bother with the CAB - they are not clued up on the unenforceability of PPC tickets.
    3) Don't contact the PPC in any way, and ignore their rubbish letters. They will threaten you with plague, pestilence and famine, then give up after 5 - 6 letters if you don't play their con game.

    I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx.     Ok fair game. My only concern is my car is registered to my mum!! Don't want people turning up at her house. Do they ever tend to take people to court for this?

    (Worst thing about this ticket ... the woman who gave me it couldn't even spell the name of the road correctly! At least if they are going to hire someone to stalk somewhere, hire someone with spelling abilities!)

    They won't turn up at anyone's house. This con trick is run via mail.

    Heya Amy... what did they call the street on the ticket?Shire Oak or St Michaels Court?

    From the advice ive being given I am going to ignore it. Have you being given any other usefull advice since your last post?

    Did you see the women who gave you the ticket? Did she tell you who 'apparently' owned this land! i am glad there is a few of us in the same situation with this parking space.

    They called in St Michaels Court even though I was parked on Shire Oak Street.

    I am going to ignore it as well, I don't actually have £75 going spare so even if I wanted to I wouldn't be paying it!!

    I think I saw her ... but not when she gave me a ticket. There was a woman sat in a car (In a restricted bay, I should have checked if she had a permit!!) and she was there all day, I saw her at least 3 times, with at least 2 hours between the first time I was there and the time I went back to show my friend where I parked! So I think it was her .. the name on the ticket was Jackie.

    I think the conclusion of this should be headingly needs more parking!! It is an absolute nightmare up there at the best of times!
