UK CPS (PPC) ticket on public road

Hi, Firstly I am so glad we have found your post! The story is...I used to/still do live above subway at the bottom of this road. The other day I came to pick up some stuff at my house, parking below the car park that used to below bt (not in the car park; next to the bushes on the road which is the leafy area bit) where from my memory there are no signs or double yellows! I was ticketed within 5minutes of being there a staggering £75 ...to pay within 10 days ....or £3 a day to be added!
Yet i cannot see where I have gone wrong...i have parked there many of time before, i am not obstructing driveways,property etc. I have rang the highways today and they say this road from what they can see is not private! I have contacted UK CPS and got through to someone who sounded as though they were driving who told me ..."its to stop people like you" and replys such as "yeah..so?"! the actual name of the street that is written on my ticket is St Michaels court....UK CPS told me "yeah same thing same street just two names?"
Could I support you on your battle with these tickets? I mean, are these tickets authentic and can be produced in court in out situations and win? Also, i noticed you have an MP involved, can I have his contact details or may he get in contact with me.
I am a bit worried as I got the ticket yesterday, I have little time to pay this and money doesnt grow on trees unfortunatly I cannot afford to have these £3 aday increases! Scare tatics by UK CPS? Please contact us back. Thanks you

No, don't contact them - you're right to think you'll never see your money again as that's all they want.
What's interesting is you say you were parked on a road the highways authority has said is 'not private'? I'm pretty sure it's an offence or fraud for a private company to allege a contract on land that they neither own nor have a contract to manage.
Someone more knowledgeable will no doubt be able to explain this point better.0 -
crabman, the highways said they own shire oak street (or st michaels court as UKCPS call it) and that the only suggestion they could make was that maybe a small part of the road is owned by a company however this is unlikely! I was parked below the ex BT carpark but on the road (I even took pictures).
So the overall opinion it seems is to not pay the fine,not contact and stand my ground on this!do they have any power to touch my car?
I heard one story of debt collectors in connection coming to someones house in the early hours!Dont know how true this is.
It is so hard to get people to listen someone with power to say Yes you owe this money etcetc or someone to fight your point.
Ive had 'real' parking tickets before (such as disk zones that are in scarborough I stayed a bit longer than i should, i got a ticket, i paid the 30 quid...i was in the wrong there but in this case????0 -
They have no power to touch your car, your house or your possessions. They can only ask you if you would like to pay them. Any more that that and you should call the police to take care of it.
Nobody can enter your home legally unless you've been to court (very unlikely), lost the case (even more unlikely, it's never happened) and then failed to pay.
Best advice is to ignore them and don't pay. What you could do is get a definitive answer from the highways authority as to whether any part of the road IS actually private. If it's all public then they could be in hot water.0 -

Have i missed the 'context' there. Who what where or when is that addressed to or is it someone talking to themselves?

Hi the context of the message is that the message is a reply to someone who commented about the situation of parking tickets. it was transferred from a previous thread.
Any who, I plan on investigating exactly who has or as the case may be does not have ownership of the road. However the Leeds hichway authorities cannot seem to deliver a specific answer. i have also looked at the UKCPS website and they expectedly stated that they do not reveal client lists for confidentiality reasons. This i find is incredibly frustrating because i do not know who has employed UKCPS to patrol this area. Can anyone help me get a clear answer as to who actually owns the road of the area i was parked... Shire Oak street, Headingley. Or can anyone point me in the right direction?0 -
If its a public road it doesn't matter who 'owns' it.

if its public road and the PPC put an invoice on your car then it is Fraud. (See the Fraud Act 2006).
PPCs operate unlawfully, some illegally, according to all the examples I have ever seen.
Just ignore them, don't be drawn in by crooks.0 -
