    Just a quick question back in 2001 I opened an account with Halifax, I had this for 4 years. During this time I had loads of bank charges. In 2005, I closed my Halifax account and went with Nationwide for about 2 years, and then went back to Halifax.

    The question I would like to ask if, could I reclaim the charges from Halifax when I first went with them back in 2001???, as I don't have any bank details etc???

    Yes you can but make sure you are clear which account you mean and send as much info as possible, ie roughly the month you closed the account, the branch you opened it in, etc, etc, don't forget usual details name, address at the time.

  • The only way I got success was to send in my last letter that I was contacting my MP for help and the FSA as my case had not been dealt with fairly as defined by Financial Hardship. I know it says they have to consider you, but not necessarily pay out. I went through each of the points as defined by Financial Hardship and argued my case. I had a reply within 7 days and an offer.

    Well, after I thought I had success with Halifax they have gone back on their word. Not really sure what to do know, apart from send yet another letter of complaint.

    I the letter I received dated 9th October they promised no fees for 3 months, and to repay one months fees. What a shock to go to check my balance today to find that yesterday £175 was taken in fees that were promised not to be applied to my account. I phoned them to be told that they can not refund the fees that should have not been applied in the first place as I was given 3 months grace. They also have no record of receiving my signed document agreeing to a partial refund, which was sent by Special Delivery so I know they have recieved it!

    What do I do now? Suppose I should send yet another letter!:confused:

    They will refund the £175.00 or you will let the FOS decide so ask them for a written confirmation as a final response that you will let the FOS decide on. Utter muppets IMHO.

    Over a number of months I have pursued the financial hardship position, following a long story over an unexpected job loss. My claim was full and detailed line by line the charges reclaimed.
    Days are numbered. The mortgage company has been to court to repossess my house and this will happen any day now. I completed a financial statement. The bank asked me how much I needed to stop repossession and I told them £1500. They then offered me £4900:j of the £12000, except the catch is that they will apply it against my account which they closed with an overdraft of £4500, and give me £400 towards the £1500 I need to keep the house.:confused: This smacks of preying on financial hardship customers when I see many customers receiving 70% -100% of their charges back.

    Ask them for more since you will still lose your house. Can I just ask how much were the charges since you lost your job?

  • hi all and thanks for the great posts and stories so far. I have followed the plan and wrote to my bank with a breakdown of the charges my wife and I had incurred.

    I have had a letter back today which includes the financial statement fo us to complete (claiming hardship) but one thing that does concern me is their paragraph that they might:

    Open a new account with no lending facility
    Return cheque books and all cheque guarantee cards
    Divert income into the new account

    This concerns me immensely but is it just a standard scare tactic ? We have a £3000 od facility on the account which we have used almost constantly for a year or so - I do not want us to lose these facilities - advice please !!!!

    All of it is FSA Waiver compliant so do not worry.
