yes it would contribute to paying off my mortgage arrears, something is better than nothing at this stage.
i had a £3000 authorised overdraft and then fell behind with repayments due to redundancy in jan. i am temping but my earnings are far far less than ever before so have fallen into arrears with everything...its been depressing but i try to remain hopeful....
i wrote to abbey offering them a payment plan (£1 token) as per my discussions with CCCS, abbey have yet to acknowledge that letter. to make matters worse they keep sending me letters from debt collectors. i even mentioned this in my fin hardship letter but they still havent backed off?
i cant believe that someone like abbey who are massive in the marketplace are allowed to get away with all of this behaviour....charges, fees, taking JSA payments, its unacceptable. sorry rant over!!
ok, so bank the cheque and sit tight, is it worth sending them a letter tho? they said if they dont hear from me they will close my case and assume all is acceptable?0 -

sounds good to me, would you happen to know where i can find the relevant letter to send abbey please??
i had concerns re banking their cheque as didnt want them to come back to me and say that i no longer had a case because id already banked it, so have been holding off.0 -

Thank you for your letter re x date which I accept as part payment towards my claim for charges. I reserve the right to pursue the remaining outstanding amount on the conclusion of the OFT test case issues.0 -

I first came to Martins claim site 3 years ago and immidiately started my claim I was determined not to accept less than I was claiming and pushed by sending a letter every week not accepting their NO WAY and their threats to close both my accounts, I even sent the then chairman a letter to his home address threatening him with a personal county court appearance, I entered the paperwork on-line several weeks prior to the hold agreement and only after the paperwork had been delivered did they negotiate but by then the letter to the chairman paid dividends as his personal secretary called and offered the full amount the same day if I agreed not to write to the chairman again (amazing I only sent 1 letter:rotfl:) Sucess but then I recieved a letter asking me to sign to say I would not disclose the agreement to the public, but as the money had been paid in and transferred out by me I wrote back saying I would sign for a contractual fee of £100,000 I never heard back!! Now it is the turn of Abbey/Santander and I have today recieved the home address of their uk chairman my claim is for £2793 I'll keep you posted.:T0 -

So I replied that I take a dim view of him being paid £1.9million in 2008 while I was being overcharged and so would keep writing I suspect I might hear from thier legal team threatening anti-harrassment laws if I continue but if they do it will lead to a day in court either way!!0

Had a reply from Halifax.
They are offering £1218 for fees applied to my account since 1st September to 9th October (unbelievable amount for 1 month!), but of course accept no liability. And no further fees for 3 months
With regard to my Right of Appropriation they have stated that they can not agree to it!
Halifax response to Social Security Act - "The Social Security Act 1992 does not prevent a bank from applying fees to a customer account"
I am accepting the money, without prejudice of course!
I want to thank everyone for their help on here. I am still pressing ahead with the remainder of the fees, and an official complaint, I still believe that my case has bot be dealt with in an appropriate manner.0
