    I support a gentleman with mental health problems who is in great financial difficulty which impacts upon his mental health. Being on benefits it is difficult for him to reduce his debt.

    We wrote to Lloyds TSB using the letter from this site.
    The bank charges amount to £2500 - we also explained the financial hardship.

    The 1st letter back from LloydsTSB just talk about a test case, they never mentioned the subject of financial hardship.

    We wrote to them again - claimed financial hardship and stated that "the fsa waiver states that you should continue to deal with the case" - but once again the reply does not touch on the subject.

    All they have said of note in this letter is - "unfortunately, having reviewed all the information available to me, I have not found any evidence that shows your situation has had a negative impact upon the way your account has been handled. This means, as we said in our opening letter, your complaint about your unplanned overdraft charges will not be progressed further until the outcome of the test case is known."

    Can anyone help me with advice on how i can get LLoyds TSB to start looking at the 'financial difficulties' aspect of the claim.

    Do you have priority debt arrears(mortgage/rent, council tax, utilities)?

    Thanks for your help so far. I have accepted the offer from Halifax of £500. (charges £5000) as you recommended. I am also writing a letter detailing the charges since my partner had to reduce her hours following the arrival of our babies. I wondered how i should word the letter ? begging ? + also would it be an idea to send a letter to this chairman chap for Halifax as i heard someone had some success. Any advice grateful. Kind regards Daniel

    You need to look at those charges since the change of circumstances and factor in the £500.00 of charges into it, ie amount minus £500.00 and ask them to consider this when they are refunding.
