    Simply tell her that the bank should give you money that you are entitled to otherwise she personally will have cost the bank £500 which is an FOS Case fee. Furthermore, you will be quite happy to go to her bosses with a personal grievance about the way she has treated you in financial difficulties with no sympathy whatsoever. Will your landlord accept some form of payment even if it is not the full amount?

    Really Bizarre !!!! I applied for FH back in June. Shabbey responded in July saying charges fair and that they believe I am not in FH and so complaint will have to wait until the test case is completed. (standard response from what I can gather)

    Today out of the blue have received another letter from Shabbey saying after careful consideration and reviewing my financial situation they are prepared to make OGWG to my account.

    Account credited today with £400.

    Bizarre..............
    If you see a penny, pick it up, all day long you'll have good luck !!!!!! :D

    No is the blunt answer. The next part of the case is about IF the terms can be assessed for fairness. The OFT will then say that they believe them to be unfair and they may apply for an injunction to stop the charges whilst the issue of which terms are unfair takes place which will probably lead to further litigation.

    I am going down after work today. I put in a claim for a Crisis Loan, but don't really want to have to borrow anymore money because of the bank.

    I'll let you know how I get on!

    Well, guess what?! Money is not available. Bank does not know what the Right of Appropriation is so spent 30 mins on the phone to be told I can not use it as they require written evidence as to what the money is to be used for, was then advised that I need to be more careful with my money! I asked how I can evidence money for food - to which I had no reply! Have to post evidence for this or fax - I really have had enough of Halifax - I have no money, application for crisis loan will not be dealt with until next week and my landlord is on my back via email and phone!

    On a happier note I was told whilst on the phone I am being offered £1200 of fees back and no further fees for 3 months! Still not sure how much I am actually owed though.

    I will do as advised natweststaffmember and make a complaint to the FSO again about not being able to use my First Right of Appropriation. I am going to see if I can get some compensation as well now.

    just got my data protection request back from Nationwide £7100
    of charges I have sent these on to the FOS so hopefully they can
    come to a decision soon they have had my hardship claim now about 5
    months does anybody know how long these are taking.
    Help gratefully received.

    wondered if anyone has experienced the following and if so please let me know.

    i applied for fin hardship with abbey, they wrote back and sent me a cheque for £515 versus my nearly £9k (this is the total in charges going back 6 years!!) clearly this is far from acceptable. in their letter they say this is a goodwill gesture and my case is on hold pending the case which is still in government i believe??

    i want to write back to abbey, theyve given me 8 weeks to reply, whats the best letter to send and do i bank the cheque or wait??

    Is the account still open? It is unusual that they send out a cheque for a financial hardship payment to be honest. Furthermore, the 6 years stopped from 27th July 2009 so you can go back an additional 2 years, ie July 2001.
