    I want to thank everyone for their help on here. I am still pressing ahead with the remainder of the fees, and an official complaint, I still believe that my case has bot be dealt with in an appropriate manner.

    They are right on the Social Security Administration Act 1992 which does not apply to it but can I ask for more clarification on the RIght of appropriation(to refresh my memory). Am I right you asked to use the first right of appropriation to pay bills and they said no or did not acknowledge it whatsoever?

    Any payout is not a full and final settlement of your claim so the rest is still live so to speak......and I have to say CONGRATULATIONS! on getting them to pay you out, I am delighted for you:j:j:j:j:j:j

    Yes I did to pay my rent, council tax etc. They said no, but did acknowledge it.

    I did research the Social Security act and sent the document into them, which states that child benefit, WFTC and housing benefit are not to be used by banks to cover the cost of unauthorised overdraft fees as the are means tested.
  • Just a quick update on Halifax,

    CLAIMING £5700 CHARGES

    I have written 9 letters to Halifax outlining our hardship claim. They initially did not want to know then after the 8th letter they agreed a good will gesture of £518 which we gratefully accepted. This amount came no where near to the total sum and did nothing to get us out of hardship. I wrote again with a court summons for £800 for council tax and a range of new unpaid bills etc ( as i have done each time they wrote to me ). They failed to reply. I called them last week to see if they had received them and also discuss the fact that our mortgage went unpaid with them this month. They refused to discuss the case any further, as a gesture they cancelled £105 of charges that where due to go out on the 13th October.

    So, Yesterday the £105 charges were taken out of our account against what they promised last week and the £518 has yet to be put into our account even though it has gone over the 14 days they originally said it would be credited to the account. 2 broken promises !! they also agreed to give us 3 months with no charges.. again they have not upheld this as we are still receiving charges galore !!

    I feel like i am fighting for nothing here ! Halifax have been so poor at dealing with our case. I sent all 18 letters and complaints form today to the FOS. I really dont hold up much hope though. Is it going to be 18 months before i hear from the FOS. I will probably be feeding my family on bread and dripping by then !!

    Vented my steam now... Cant wait to pay off my £3400 overdraft with Halifax and bring my mortgage up to date then i will be closing my accounts with pleasure !!:mad:

    With regards to both counts I would write to Halifax and get them to refund any charges since you agreed with their proposal.

    That is about charges relating to a court ordered debt ie assignment of debt. It does not apply to bank charges. If the appropriation letter stated that you wanted to use it so that you could pay for x bill and y bill then I think you have a secondary complaint with regards to them not allowing you to do so.

  • I will send them a letter but im kind of getting to the point were i am banging my head against the wall !! I have detailed these points in my FOS complaint so hopefully that will add weight. I am truely staggered that Halifax have gone against all of there words. The continued taking of these charges has meant that i have defaulted on many payments again this month. Is it worth sending them all of the charges i have received from these companies or ask for some kind of compensation. I nearly give up !!

    If you give up then they win. Giving up is not an option(believe me they will refund the charges since you agreed to it prior to them adding it). The fact they are taking so long to actually deal with the agreement is not your problem but is theirs :D
    The bank want you to give up so are you going to let them walk all over you again, now that you know your rights? Never give up.

    Just a quick question back in 2001 I opened an account with Halifax, I had this for 4 years. During this time I had loads of bank charges. In 2005, I closed my Halifax account and went with Nationwide for about 2 years, and then went back to Halifax.

    The question I would like to ask if, could I reclaim the charges from Halifax when I first went with them back in 2001???, as I don't have any bank details etc???
