Credit card arrears are non priority debts(but there must be charges on those too and they are easier to reclaim). Are you behind on council tax and utilities?0 -
Thank you for your reply. I cant remember when the account was opened but was active after 2002. The account was fully paid up and no arrears were left it just happened that when i payed a cheque in the funds became available almost straight away so i withdrew on it but then bounced a few days later leaving me overdrawn.0

I would just like to thank this website, i succesfully received 1200 of my 1600 original claim back from Barclays under the financial hardship rules. it took about 1 month after putting the claim for financial hardship in and the only reason i put it in was because i put a claim for a refund back in september and had notification from Barclays in may that they wished to review my case, I had to fill in a questionaire and had confirmation that i qualified for financial hardship.
I may not have got all the money back but 3/4's is definately more than i thought i would get back.
Thanks to the website for all the help0 -
Bank: HSBC
Amount Reclaimed: £1,391.50 + interest
Amount they paid: £1,484.50
How long did it take: 5 weeks
I sent in first letter using templates from this site including a lot of information relating to hardship including an HSBC income/expenditure sheet. I received a generic rejection (awaiting outcome of court case etc).
I sent the second letter insisting on FSA/Hardship guidelines. The bank then called me and we spent 20 minutes running through my detailed situation - a few more on hold and they made the decision to refund there and then.
Now have this confirmed in writing and it leaves me open to continue the claim for interest in the future should the case be ruled against the banks.
I also had £480 of charges refunded on my business account, not because they were unfair but unfairly applied (long story but a £3.24 dip into the red cost £480 in accumulated charges).
All in, a welcome surprise...0 -

The bank are owed the balance of the cheque but the rest will be charges and claimable. The fact the cheque bounced means that the bank legitimately debited your account at that time.0 -

I am currently claiming from HSBC through bank-smart as i didn't find this site until after i'd started. I have just had my claim forwarded to FOS as HSBC have not responded to my claim for hardship. Has anyone else used bank smart, does anyone know how long it takes once the ombudsman is speaking to the bank??? Any response would be welcomed0
