Bank: Nationwide
Amount Reclaimed:£1200 +£300 interest
Amount they paid: £450
How long did it take: 2 months exactly.
Although not all of the money, its a start and will clear my outstanding overdraft with NW, plus have a still left over. I can now cancel my payments to nationwide.
I will leave the account open, as there is still more to claim, once the appeal has gone through. Hopefully another £800 to come my way.
Now onto HSBC.....
Keep fighting guys. I intially got refused as per their letter i accepted the charges etc. when i signed up for the account. I then mentioned that i wanted to take it to the FOS, but before i could i had go through to their stage 2 complains. Spoke to a chap called Mark who was dealing with my case and i have to say, he was very helpful. He promised he would get back to me this week and he did.
Just don't give in, it's a game to the banks, just play the game!0 -
Hi, Just a bit of advice needed really. My husband sent his claim letter to Natwest in June 2007 for a total of £2691, obviously this has been on hold since.
He has not worked for over a year now due to illness so we wondered about claiming for hardship. The problem is that we have an account each (mine with RBS), and when he stopped working we moved all of the direct debits to my account for safety.
Despite me working full time we are struggling to maintain everything, although somehow we normally manage to pay things, even if it means we have nothing left and have to borrow from family until pay day. I have had a few charges on my account but nothing really on his lately.
I'm just wondering if they will view this as financial hardship as his bank statements will only show a loan payment and an insurance payment coming out every month? (He receives incapacity benefit by the way)
Sorry if this is long-winded, just wondered if it was worth trying. I guess it can't hurt.

Hi I have just finally started trying to get to grips with my finances after years of burying my head in the sand. Just wondered if someone can advise.
I am currently in the process of trying to reclaim my bank charges from hsbc on the financial hardship basis. I have sucessfully received list of my charges which amount to approx £4,000 (yes i know)
I have sent the initial letter claiming with interest 14 days ago, along with my evidence i am under hardship. So far i have heard nothing. Do i now send the second letter?
My other question is i intend to close my HSBC account and have opened another account with LLoyds TSB. I have now moved all my direct debits and my wages to the new account.
Will it cause a problem if i close the account I am claiming charges on? I do still have a loan and credit card with HSBC which I switched payment to the Lloyds TSB account.
Should i keep it open until this has been resolved or can I close it.0 -

ok so i have recieved reply from barclays from letter 2
they have said that they are sorry for financial hardship but as the courts have suspended claims until final hearing they will put the claim on hold so i have now sent letter 3 ,do they not understand that claims for hardship have to be looked at,they have also sent a second letter with reply saying that they believe there charges are fair:mad:. is this a stalling tactic because if it is im not having it, they are the main cause for my claim cancelling dd's even when i was not over my overdraft causing fees until i was over my limit and therefore not paying my creditors. i will fight to the end and let you know how i get on,if anyone has any other ideas i would be gratefull to hear from you.0 -

Do you have any priority debt arrears(rent/mortgage, council tax, utilities)?0 -
hi yes i have second mortgage arrears,credit card arrears, unpaid bills,and have been threatened by card companies with court orders, barclays have accepted that im in finacial hardship in there letter,luckily my mortgage comes out on the first day i get paid and the rest is wiped by unpaid bills etc and then more, i have nothing to live on as all goes straight away and creditors are getting little an often as funds allow before overdraft gone again because of excess charges adding up every month.?0

I would send each bank you details ie name date of birth address at the time the account was open etc, etc,. When was the accounts closed?
Are you not paying them back?0
