    This claim under hardship was started in Feb 2009 and has been a real slog. At least a dozen letters sent and received and a complaint lodged with FOS. In the end they agreed to refund all charges including those applied since I started the complaint back in Feb 2009. Sent my acceptance off today so hopefully they will credit my account ASAP. Good luck to all those still fighting. Don't give up.

    Must be RBS!!!!!! I was in the same situation as you. Sent my form off after claiming financial hardship in Feb 2009! Got a reply back saying you dont fit the criteria?!?! Couldnt understand why as I was nearly 4K in arrears with the mortgage, threatened by power co. about getting cut off and court papers for unpaid items and also reposession. To top it off I was nearly 1k o/d with no overdraft facility coz they took a big wack of charges off. This was right before my payday. Phoned up to ask what could be done as my wages would get swallowed up by that amount. Again told "dont fit the criteria" and "tough" (that is a genuine quote by the way!) that my wages would be swallowed up when they hit the account! Sent a letter of appeal and again got the "dont fit the criteria" letter back. I had had enough so phoned them spoke to a lovely woman who couldnt help me enough. They had missed out the mortgage payments and arrears???? on their system and hadn't put in some other amount as well and she immediately sent out a letter of offer. I had claimed just over 3K in charges. My letter arrived offering me £4153. Sent that off 4 days ago and the money was in my account today after speaking to another lovely lady who sorted it out for me. Thanks to all on here who without I would have gave up a long time ago!!!!!!! Thats 4K off my debts only another 5K to go!

    My case has been ongoing for over 16 months. I have gone down the hardship route, and today HSBC called to review my current situation. They have offered me £455, (£702 is the figure including interest) I am really not sure whether to accept this payment or try and get the full amount???? An acceptance letter is going in the post to me on Monday.

    Any thoughts anyone? would you accept a reduced offer?

    Well the offer is not in full and final settlement of the account since they are not allowed to. I am intrigued though that they are offering a refund of charges even though you do not have priority debt arrear(mortgage/rent, council tax, utilities).
    EDIT complete misread.....need to get some caffeine.
    I would accept the offer and does this help clear your arrears?

  • sent off my templates yday to lloyds and rbos asking 4 list of all charges ive paid 4 last 6 yrs, i was with rbos up until 2002 then joined lloyds and stil with them,so asked rbos 4 charges going back to 1999 to 2002,i know the rule is 6yrs but sum people hav claimed back further and succeeded and i thought wot i hav got 2 lose,im in financial hardship and it was only last week when lloyds rang me to tel me to hand in my current account debit card to downgrade it to a standard cashline card where u can only draw money,if anyone has any advice i wud be really grateful,wil let u know how i get on,thanks.

    As it stands today, you can only claim back until July 2001. RBS will not make an offer since the account is closed. Lloyds are appearing to finally follow the FSA Waiver so I would return the card and I would expect and offer from LTSB

    Hi,

    Nat West & RBS - three bank accounts, total charges c £3500, 5 months to get it all back!

    I lost my job in January so started the process to get a refund of my charges. After the usual letters, they sent me an income and expenditure sheet (one for each account) which i completed and sent back. There then followed letters on each account asking for further information - funny really as they're the same bank but each one asked different questions. Finally got an offer on each account for the full amount( 3 offers, three envelopes) which i've accepted - and am just waiting to actually see the cash.

    Very many tahnks to all the info on teh site which helped me get this far - a definate result
  • hi i am in the process of claiming off rbs and haifax and have sent of the income and expenditure forms.I have 4k mortgage arrears,2.5k in gas/electric arrears and £450 council tax arrears which i have agreed to pay bavk at £75 a month.My husband has had his hours cut and i am on maternity leave. What are my chances guys.

    help!!! i put a cliam in for financial hardship with Halifax in February. After 12 weeks they offered me £35( they owe me about £3000!!!) i obviously rejected tjis and my claim has been with the Financial Ombudsman for about 8 weeks. I have had absolutley no correspondence since and have no idea how far on my claim is. I have emailed several times and had no reply. where should i go from here? I have just had a huuuuuge electricity bill through that i definetly cant afford to pay

    When I claimed back from the Clydesdale Bank both of my accounts were closed and had been for years, so why is it RBS wont offer?
