I was successful in claiming, and the lady i dealt with was very helpful. The account was closed at the time, and I was told I could call back fter 2 months for another bite of the cherry (the paid 2 months of my priority debt arrears payments). Although now I have called back, and the state they do not have to deal with me as the case is closed!Trying to get out of debt......it's a slow but satisfying road! :j

Just received a letter from Natwest to say that my claim for the refund of charges will be accepted due financial hardship and that an offer letter will be in the post! Fab!!!
Then it says once Ive accepted the offer they will pay the amount into my Natwest account!
I still have an outstanding overdraft on that account which I am paying off slowly! Will they use the refund to clear the overdraft or will I be able to access the money once in my account?
Anyone been in a similar situation and can advise?

Yes, unfortunately this seems to be a common practice that monies awarded for unfair charges are being used to clear their own debts first. So, sorry the monies will be paid into the account with the O/D and any left over will be yours to access as you please.
Suppose you could call them and request they credit to another account but I wouldnt hold your breath.
Doesnt seem fair does it. Your money but who are the bank to stipulate where you spend it.
(am unsure about the legality of this, but I am aware that OP have been in the same boat and have been unsuccessful) No harm in trying though.If you see a penny, pick it up, all day long you'll have good luck !!!!!!0 -

I have queried this with the FOS and they have said basically that the bank have to refund into the account the monies were taken from. The right of Offset overrides the right of appropriation on refunds. Might be worth negotiation though.0 -
Happy to say that 1 week after returning my acceptance slip Natwest credited £5,568 into my current account... Thank you again Martin!0

No they didnt touch any of my accounts, I have two personal accounts, a visa card and an old business account and they didnt ask me for any of the cards back or downgrade any of them?
I found them very easy to deal with compared to Halifax who are complete Hitlers compared!
Once you start to make progress with Barclays (and I called them every other day to stay on top of it but was always polite) you get very quick closure on it. I think it was 2 weeks after the case was referred to a senior caseworker I got an amount paid straight in to my bank account as a goodwill gesture, no questions asked and not even a letter telling me - they are very good about it there and everyone that has been accepted as hardship seems to be paid out?

I have wrote hardship letter 3 times just keep getting letter saying we are looking into it and then nothing :mad: am thinking rather than keep writing and trying to ring them what a joke still no result am thinking maybe just contacting ombudsmen without wasting time with lloyds what do you think0

This claim under hardship was started in Feb 2009 and has been a real slog. At least a dozen letters sent and received and a complaint lodged with FOS. In the end they agreed to refund all charges including those applied since I started the complaint back in Feb 2009. Sent my acceptance off today so hopefully they will credit my account ASAP. Good luck to all those still fighting. Don't give up.0 -

Story - initial claim put on hold - sent financial difficulties letter in April 2009 after court case was delayed yet again. Received letter in May asking for full statement of income and expenditure - despite enclosing a budget with my April letter. Letter in June out of the blue stating £945 paid into my account. Account now in credit! Thank you MSE for all your help."I have enough money to last me the rest of my life, unless I buy something"0
