    Hi there

    I wonder if anyone can help me. I have written to HBOS twice now informing them i am in financial hardship and twice they have came back and said 'no your not'.

    Has anyone else had this response from them? and if so what was your response? Have you been successful?

    ps: I can proove that i am in financial hardship, mainly due to having to move to a lower paying job.

    hi halifax have agreed im in hardship but as yet nothing else has happened
  • i used the templates on this site and posted them to my local lloyds and rbos bank,they r both literally 100metres away,i did this because it is with these 2 banks i had/hav accounts with and didnt want 2 risk sending the letters to london or sumwhere 4 them 2 reply saying contact your local branch 4 the list of charges,so its a timesaver in a way i suppose,i know they hav 40 days to reply,they wil probably wait until this maximum deadline 2 send them out as wel 4 delaying purposes.
    also when i get these lists of charges do i sent my claim 4 refund letter back 2 my local branch or is there a head office that deals with these?
    You always send data protection act letters to the data controller. By going to the branch they will be delayed getting to the right department. When you get the charges they should go back to 27th July 2001 under the FSA Waiver which you then send to head office addresses(recorded delivery so you know they will get it).

    That isn't hardship by the way, priority debt arrears(mortgage/rent council tax utilities) are.

  • Ok, lets go back a step or two. Did you write to Lloyds TSB and what response did you get?
    Are you in financial hardship and do you have priority debt arrears(mortgage/rent, council tax, utilities)?
    Are the arrears being paid off?
    Hi again tsb have accepted that im in financial hardship but there saying that my claim is still on hold ive now taken my claim to the fos just wanted to no how long these things take to sort out cheers Paul

    Hi, I have just spoken to someome at andover, they are saying that although they agree that iam in hardship they will not be paying out until after the test case, just wondering if it is worth going to the fos or not as lloyds seem determined not to pay out anyway:mad:

    That didn't really answer the questions I asked. Are there arrears on priority debt arrears? Are they being repaid?
    Did you get a final response letter from LloydsTSB explaining why they class you as being in hardship but have to wait?

    Same questions really, do you have priority debt arrears(mortgage/rent council tax, utilities)? Are you repaying any of the arrears?
    Do you still use the account?

    halifax accepted im in hardship and made a goodwill gesture of £28.00 and no charges for 3 months, phoned them and asked them to reconsider as am being taking to court re council tax arrears and was told that it was the only offer they could make, and wouldnt be able to reconsider, told them i would be contacting the fos, will be sending letter tomorrow with all details and correspondence re claim is it worth trying to contact halifax again and does anyone know how long the fos are taking to look at complaints

    Bexie, get them to send out a final response which should have their decision making on it then we can work on the FOS stuff.
    At the moment you need: ALL correspondence between you and the bank
    You need an income and expenditure form(do you need a link to one?)
    you need to copy any arrears notices
    Last thing we need is their final response(FOS can take up to 12 weeks with this info or longer without it).
    What you need to see is why they have decided on that amount. You will have to argue that the hardship started at one point because of a lifestyle change, ie loss of job and how that loss of income lead to the charges and the effect on you.
    Furthermore, you have to be able to argue against the points halifax makes on their final response.
