hi natweststaffmember, phoned halifax today and they wouldnt reconsider the £28.00 goodwill gesture, so I asked them to send me a final response letter, which the guy on phone said they already had so I pointed out to him that it was an offer and did not say anything about a final response, so he said he woul get one in the post to me today, but the offer is on my current account which I hadnt claimed on as it only had a couple of charges on, they havent mentioned anything about the account I am claiming on so am a bit confused.

bexie, once you have it can you send me a private message and I can start a thread for you to respond on with a copy of the letter or alternatively if you know how to start a new thread can you start with the letter and we will see what they have done.

  • i requested hardship in august 2008 last year from barclays i forgot all about it untill i had a budgeting form through the post in may 2009 i filled it out and got a cheaque in through the post for £2200 3 weeks later which was £900 less than my charges after the interest i added. i have no debts i had lost my job and am on benefits whilst looking for a job so this money has paid back all the hard times i had to go through month after month of charges.

Hi, I have just spoken to someome at andover, they are saying that although they agree that iam in hardship they will not be paying out until after the test case, just wondering if it is worth going to the fos or not as lloyds seem determined not to pay out anyway:mad:

I have spoken to the FSA about Lloyds.
The FSA tell me that this is clearly a breach of their rules, if a bank agrees you are in hardship, they HAVE to process your case.

The FSA have also told me that whilst they will not deal with individual cases (use the FOS for that) you should send copies of Lloyds letters to them with a covering letter which states that you believe the FSA should be made aware of what Lloyds is doing.

The FSA have said that if they receive similar information from different people, showing that its not just a one-off, they WILL take action against Lloyds

To clarify, they don't HAVE to refund any bank charges under financial hardship even if you are in hardship.

Yes, they can refuse to refund you, but they HAVE to look at your case and give you a decision, one way or the other!

Yes, I know but they have to have all the information available to them or they can:

    "6.
Where the firm does not have sufficient evidence to assess whether or not the complainant is in fact in financial difficulty, the firm will seek such further relevant information as is reasonably required to make that assessment. In the event that the firm reasonably requires relevant information to be provided by the complainant and the complainant does not provide the requested information within a reasonable period of time, the firm shall not be obliged to treat such a complainant as being in financial difficulty"

  • Hi folks not sure if Im putting this in the right place but here goes.

A very happy bunny I am after winning a financial hardship case against NatWest.

Started this back in 2008 just before everything was put on hold and backed off as wasn't too sure what the next step was. However due to personal changes in my life and subsequent financial hardship I pressed on. I must say though every single person I spoke to on the phone at Natwest was extremely polite and as helpful as they could be. Better than other people have been experiencing at other banks.

Im embarrassed to say that I had managed to rack up thousands of pounds in bank charges which I duly paid back each month sometimes causing a great deal of stress. I would get back on track and then something else would go wrong and off we went again sometimes charges were amounting to £300 or more a month.

My financial hardship claim was genuine as I was left with a stack of debt when my husband left. Im soooo happy that NatWest decided to play ball. The relief is amazing so all those others that are awaiting this happy day - kept on and dont give up.

    Good Luck
