    amount claiming £157
    Amount reclaimed £157
    After reading other peoples problems when trying to get back bank charges, i reluctantly thought i would have a go.it was only a small amount to some people( £157.00 ) but as i am on incapacity benefit that is a huge amount.
    They got my first letter on the 18th April 2009, sent me the financial hardship letter to fill in.
    I then got a letter saying they were not going to refund anything due to the account in question hadnt been credited or debited since last august.
    I had re-directed my benefits to my partners account in dispute of the charges.
    I then spoke to an advisor friday 24th . the advisor said she would speak to her manager and her manager would call me back on mon morning 27th may 2009.
    I waited until 12pm then called them, the advisor who i spoke to said there was no record of me calling on the friday. so i demanded to speak to a manager. she put me through to a manager of another dept who couldnt help at all, but promised the manager of the Refund of Charges team would call me on tues 5th may 2009.
    After expressing my anger about the previous advisor and my situation she said i would receive a letter in the post by friday 8th May 2009.
    I received the letter this morning saying they have reconsidered my financial hardship request and they have refunded the full £157
    Get the head of the refunds team to call you back - worked for me

    I have been reading the whole thread and there seems to be one or two success stories from Alliance and Leicester, are there any people reclaiming under hardships from this bank?
    Am asking because I just sent a letter tuesday just gone and haven't heard anything yet, I lost my husband in june '06 and since then, am behind with all bills and I mean all. I've stated all in my letter plus the fact that am back to full time education and have two little ones under the age of 5years. Do you guys think I might be accepted? I really need this money. Am reclaiming £2176 + £543.42 interest. I had done so before the test case malaky came about so am keeping my fingers x and hoping for te best.

    Hi,

    I claimed ages ago with Nat West - i wernt right back to 2002 (i think) and obviously they wrote to me to say my claim was on hold. In March i applied for Hardship - wasnt sure if i'd qualify but filled in the form. Hadnt heard anything at all so gave them a call and they said my claim had been passed onto the collections team and gave me their number so i called them up and spoke to a woman who said if i faxed her some proof of hardship (eg missed payment letters or proof of priority debt) then she could make the decision that same day. I faxed for free from my branch and called to check she'd received. She called me back a few hours later and said that it had been approved and that they would go through the claim and send me an offer letter in the next few days. this was on wednesday but ive not been home since so hopefully it will be waiting for me tmrw. Not sure what the offer will be but was claiming for over 2k so will post when i find out.

    main point is once i actually spoke to someone it was all very quick and the lady i spoke to was very helpful and nice. I made sure i was a nice as i could be back!!

    hope this helps....

    NatWest are talking a pile of crap. The FSA Waiver quotes about limitations periods.

    "(14)
    the firm must not take into account the period between 27 July 2007 and the date of termination of this direction (the “stay period”) for the purposes of relying on any limitation period (or periods) or time limits within which complainants must:
    (a)
    make relevant charges complaints;
    (b)
    refer relevant charges complaints to the Ombudsman; or
    (c)
    bring claims before the court;
    and the firm must not otherwise limit any redress that may be due to the customer, when complying with DISP or otherwise, because of the stay period;"

    If its been 9 weeks already you have every right to take it to the Financial Ombudsman Service.

    They agreed I qualified for hardship- but added that their charges are legal so stand and say they will keep doing so - until a change in the law prevents them. Same boat as you- they offers a debt managment appointment- Thing is- I would be in debt if it want for them and their damn charges!
  • Hi, this was a few years ago when all this first started but I managed to claim £1500 back from Natwest in a matter of months, possibly 6 months in total. I was gobsmacked needless to say as I thought they would never pay out. The nice little sum went on a deposit and first months rent in my new flat. I am currently trying to claim more from Alliance and Leicester but the sum is much much smaller so im not hopeful. Nice if you can get it though
