How long did it take: AROUND 1 MONTH
The story:
Started the reclaiming process around a month ago. They sent us the income/expenditure forms which we filled in and sent off around the beginning of April. We phoned them at least twice per week (not sure if this helped?) stating that we were getting desperate, and sorry to keep phoning all the time.
We phoned them on wednesday (the day after their stated cut-off decision time) to be told they'd put a letter in the post to us on 20th and it would be here within a couple of days.
The letter never turned up so OH phoned them about 15 mins ago to be told the letter was probably lost in the post but they'd resolved the case at 9.57am this morning by depositing some money into our account. £2159.25p
Just incase it helps anyone, FYI -
we put on our income/expenditure forms that we were sorry that we had to claim from them, but we wouldn't be doing it unless we HAD TO. And explained how hard we were finding it to meet our repayments and arrears payments, and having to borrow money monthly from my parents which is really demoralising.
We also put about how the children are missing out on things.
Can't express just how relieved we are - we were wondering just how we were going to be able to pay the mortgage this month. When OH got off the phone and told me, i actually cried with relief
I honestly believed that they would turn us down, so please don't give up hope anyone who's reclaiming xxxx

Amount claimed: 6300 inc interest
Offer: To pay back 6 years, but not mentioned interest
Following guidelines from Martin Lewis, requested 6300 including interest based on hardship. They sent financial statement for completion. Delayed a few times asking stupid questions, but now advise will pay back 6 years but did not mention interest in call. They want to pay my creditors direct, and havent sent me a letter to confirm. They want proof of amounts owing so they will settle. Dont really mind, as it reduces what I owe, however when asked if they were sending a letter, they advised just to send up to date proof of outstanding bills. Took about 6 weeks to get this far!
Is this a reasonable offer? Should I await a letter and should I have to confirm acceptance by letter once officially received?0 -

Yep thats a decent offer. Paying your creditors direct is a good thing, means you can't get tempted to buy a new toaster lol. I'd send in the evidences and details of the arrears you need to be paid as indicated in the call, or give them another call and ask them if they are writing to you with the offer outline first. The remainder of your claim (the interest and any additional charges) will still stand and be sorted after the test case concludes.LegalBeagles0 -
I have a court claim for £2000 put on hold so I applied for hardship. I duly completed the form they sent me. They were quick in agreeing my claim for hardship but only paid me £1200 as a "gesture of goodwill" awaiting the conclusion of my court claim. The letter states that if the court claim is successful, the £1200 will form part of the award. Does anyone know the legal implications of this?0

Put my claim in Feb 09 under the financial hardship waiver as i had mortgage arrears, credit cards arrears etc. Got refused and told i didnt fit the criteria - made an appeal about six weeks ago saying my situation had got worse and received a letter in the post yesterday saying my claim had been accepted and no more charges or interest would be added to my account.
Have to post my debit card back to them and they will notify me of the amount and it will be in my account within 21 days.

I received a letter today from Abbey to say that after careful consideration they were willing to refund £2970.45, which is all the charges I claimed, plus ,more that have been debited since I started the claim. This now leaves me with just £25 to pay, to clear the account, which wouldn;t of actually gone so bad if they hadn;t swiped my overdraft off me !!!!!
The whole process took about 8 weeks, and I am happy happy happy !!!0 -

The Story....Received a letter today with an offer of £524 after claiming under financial hardship. I first wrote about 10 weeks ago and was told a couple of weeks ago they were still looking into my case and basically told me to write to FOS. I did write to them and received forms etc but not sent them back. They Abbey told me today when I called them,the £524 was to help as I am behind with my secured loan and I would get the rest when the test case ends. TBH this is a bonus so I,m gonna acccept this as skint and was the last thing I expected as thought the Abbey would reject my claim.
Anyone with any doubt about claiming under financial hardship...go for it as you never know.

Barclays Bank
£1745.97
Started trying to reclaim bank charges from Barclays this time last year to get in the queue whilst everything on hold. Then in July Husband taken very ill and lost his job so tried again under hardship ruling. Completed income and expenditure forms showing how tight money was, along with full explanatory letter but still Barclays refused to be moved. Contacted Financial Ombudsman and they investigated but ruled that Barclays were correct in saying that although we were in financial hardship the hardship had not been caused by charges from Barclays and therefore claim would stay on hold.
Decided to withold payment on overdraft of £214.00 and Barclays started to get funny and asked for debit card back so last week decided to have another go using the updated template on the moneysaving expert website for those suffering financial hardship.
Today I received a letter from Barclays telling me that the sum of £1745.97 has been credited to my account. Just phoned the bank and yes the money was there.
Moral of the story don't give up, if at first you don't succeed keep trying.
