Just received £1000 of a £3500 claim, going down the financial hardship route. Was told this would not effect my claim and the remainder would be issued if case is lost.
Was a bit annoyed with the lady I spoke to who was trying to determin whether I qualified.She asked if I could do without my car.We live 8 miles from the nearest shops(rural living for you) and only have a bus twice a day.
We don't go out,rent movies,have take aways,drink or have holidays, and then she asked if my husband could stop smoking.!!!!!!
I thought she would next be asking if I could reuse the tea bags lol.0 -

Just wanted to let you all know to keep on contacting the banks. I wrote to Barclays bank last year (august time) to reclaim £1400 bank charges, got a letter back to say about the test case etc and didnt do anythng more infact forgot about it to be honest and then yesterday I got a cheque for £1100 !!
Cant believe it, the bank agreed I was in financial hardship and as a "gesture of goodwill" paid back £1100.
Hang on in there and give them time to process your claim. It certaining paid off for me.

I got a letter from Barclaycard yesterday to say they are paying me my £413.13 that I requested only 2 weeks ago!!!

The story: Orginally claimed back in 2007 but was put on hold like everyone else. Back on 28th February 2009 i decided to apply under the hardhsip rules. I sent 1st template letter through internet banking and was sent one backsaying they are lawful etc. Then sent off the second template letter, again through internet banking and was sent back another standard we're not paying out one. Then sent a third and final message back threatening court action and was told that my case had been passed to the complaints department. I also received a letter through the post informing me that this had happened. This morning i checked my account and have seen that they have refunded everyone of the charges, apart from a £10 one. Im sure i also have a letter as well, although that gets sent to my Parents house so i only check it once a fortnight. This was all done via internet banking so was completely painless for me. It took a little over 6 weeks to complete from start to finish and im very happy. RESULT!!Thinking it over...:o0 -
Abbey - £2200 (successfully reclaimed full amount of the 6 years charges)
Case took 6 weeks to complete - Abbey were very easy to deal with all I had to do was send income and expenditure form along with copy of my redundancy letter and arrears letter from halifax to prove financial hardship. I'd suggest sending as much info as possible and the income and expenditure form has to show that you have less money coming in than what goes out for essentials like mortgage, gas, electric, food etc
Intelligent finance (part of halifax)- £700 (successful in reclaiming all of the 6 years charges)
Case took nearly 3 months. They initially said it would be sorted in a month. Totally not the case. They wouldn't accept the abbey income and expenditure form they wanted to use their own version. Eventually got it sorted though but they paid the money directly off my halifax mortgage arrears.
I'm now in the process of claiming my mortgage exit fees with both companies as per Martin's instructions. :T0 -
Halifax offered me £896 which was only for the last two months charges so I declined the payment. Has anyone else done this and got any further?0

Hi all, I have filed a complaint with the ombudsman to try to claim my bank charges back from the halifax and abbey, i am still waiting but have had a reply from the ombudsman saying they are now awaiting a response from the banks. When dealing with the halifax to get my charges back via the poverty ruling, they repeatedly hung up on me. SHAME ON YOU HALIFAX !!!!!
I have also had two successes regarding claiming back credit card charges thanks to martins cover letters.
so far i have claimed back £116 inc 8% interest from barclaycard and £464 inc 8% interest from alliance and leicester HA HA HA
I also tried to have my credit score reversed but they refused...Any ideas how to overcome this???

I also forgot to mention that halifax offered me £100 to basicaly shut the case against them. I told them to poke it as they owe me £1500 ha hah ahaha0 -

The story: Case was put on 'hold' 2 days before the end of the agreed period with Judge to reach a resolution with Barclays. Wrote to Barclays before Christmas stating I felt I was within my rights to re-commence the claim as I was suffering financial hardship. They wrote back with a form asking me for expenditure details. Last week received a cheque for £3,800 as a 'goodwill gesture' and that this would be deducted from any monies they are ordered to pay me by a Court or Regulatory Body. Fingers crossed I get the rest back at some point too...0
