    HI Alfieg,

I got the same too - but they will pay the rest after the test case, I banked the cheque (as its only a goodwill gesture after all) and am holding out for the test case to conclude for the rest!

I've had a breif glimpse through this thread (sorry if I've missed out the important bits!) - it doesn't appear there has been any success stories with LTSB - I am in financial difficulty - but unsure as to how I prove that to LTSB - as I am "running my current account" - making Standing order payments, debit card payments etc. - In the last year, I have also fallen prey to over £500 of charges from them - they sent me the standard "on hold" letter - however, I am now planning to go for the "hardship" - but wondered what level of "proof" they required?? I'm worried they will close down my account and I will then not be able to make the payments to my creditors I need to - I do not have a parachute account - nor will I be able to open one - my creditors seem to have taken over all the other banks!!!!

    Bank: Natwest (husbands account)
    Amount Reclaimed: £6035 (including interest)
Amount they paid: £4835 (bank charges without interest)
The story: sent letter off to Natwest claiming financial hardship, they sent back income/expenditure forms, they then wrote asking for proof of some of the bills etc. wrote to us today offering £4835!!!!!:money: :money:
Money should be in husbands account within 21 days!!!!!!!!!!!!!!!!!

I'm just wondering if i should go for the lot, as i don't trust the goodwill gesture. The reason for this is that i have seen insurance companies use this tactic to under pay on claims when cars are written off, i will explain.

Basically, the insurance company will offer you way less than what you valued your car at on the premium. They are entitled to do this as they offer what they feel the market value is although this is usually not a fair reflection. Anyhow, i have a process that i get my friends to go through when claiming, which pretty much guarantees a larger payout. What the insurance companies do is, while you are arguing that the amount of money they have offered is not acceptable, they will normally send a cheque for the original payout offer stating that it is a goodwill gesture and that they will send an additional cheque once an agreement has been made on the final value of the car. The thing is, if you cash the cheque, the insurance company then say that you have accepted their offer and close the case and you cannot continue the claim for more money. I am just worried that if i cash this cheque, then the banks will apply the same tactic as the insurers do.

I have actually realised tonight that i have made a mistake on the interest and under claimed by £350 in the first instance, so infact the offer of goodwill is way less that it should be, almost half the total charges with interest. I am going to call them tomorrow and see if they will negotiate on the phone, if not i will send another letter with amended interest and ask for the lot.

Barclays paid out 2k on a 3k claim. Took just over a week when I went down the hardship route. I might give them a bell and see if they'll give me the rest while they are in such a good mood.:rotfl:
  • how did you get Barclays to reply so quickly? I started my claim last June, then sent a letter 3 weeks ago stating i was in financial hardship and have not received a reply yet????

Pot luck I think. I did mention that they were threatening me with repo so that may have helped.
  • Barafear 799,

I am in the same shoes, I applied for all my charges to be refunded about 18 months ago now and was told the usual awaiting result of test case which by looks of it is only gonna go one way! (in our favour!) .

Anyway I tried the hardship road and did this via the Financial Ombudsman lloyds had 28 days to issue a response which should have ended last week and still heard nothing from both Lloyds or the Financial Ombudsman.

It seems some banks have almost conceeded defeat and chossing to pay out now but some like Lloyds are dragging their heels but inevitably they will pay out in the end!

    Hope this helps

    Have I missed something?

I am reading positive results on reclaims froms Banks, I thought that major banks put in an appeal against the decision so that put a hold on existing claims and new ones pending the result of the Appeal court?
