Hello there
I am trying to claim back past charges from my bank (Natwest)
I've got as far as sending a subject access request, I used the pro forma on the consumer action group website and enclosed a cheque for £10.00. I have copies of the letter and the cheque which was sent well over 40 days ago. I have had no reply, what should my next step be?
I have no proof that the letter was recieved by my bank.
Any help would be greatly appreciated, thanks!

That's great well done :j

Page e, we got a letter telling us how the charges were legal etc but offering us the full amount. At 9am the following day we got a phone call from them asking if we were accepting, said I needed to speak to Dh, got another phone call later the same day asking if we would accept. DH agreed and we sent confirmation the next day.(and cancelled court)
Good luck and hope that helps0 -
Hi all
I am currently in the process of reclaiming bank charges from LTSB, it has got to the stage now that the one month stay is due to end tomorrow (13/11/06) it states on the letter of stay received from the court that 'on or before 27 November 2006, one of the following steps must be taken:
the claimant must notify the court that the whole of the claim has been settled;
Or
the claimant or defendant must write to the court requesting an extension of the stay period, explaining the steps being taken towards settlement and identifying any mediator, expert or other person helping with the process. The letter should confirm the agreement of all the other parties.
Or
all the parties must file a completed allocation questionnaire at the court. Where a settlement of some of the issues in dispute has been reached, a list of those issue should be attached to the completed questionnaire. The list must be agreed with the other parties and must indicate that it has been agreed.
I have received no contact from my bank at any time since court action started or during the one month stay, could anybody give me any advice on what I should do now please.
Many thanks

Please can someone help me. I am in the process of claiming back charges from CITIFINANCIAL and BARCLAYS. I have already issued proceedings against them and have received this morning 'Forms of Judegement or Order' for both Barclays and Citi, my hearings will be at Cardif County Court on the 21st December, but on the order against Barclays it is ordered that the stay is lifted. What does this mean? have I done something wrong?
Also, I am aware that I have to prepare a court bundle, do i send this to court prior to my hearings or do I take them to court with me on the day?
As always advice is greatly appreciated. Thanks0 -

You can't you have to know what you are asking for. As soon as you send the first letter in you are signalling your intent to claim your charges back. Asking for your statments or charges is your legal right under the DPA!! So send in your £10 and ask for them back for the past 6 years, then you can start.Littlewoods catalogue - won back charges of £300 by default.

You dont necessarily need proof that it was recieved, just that it was sent. That is why it is advised that all letters sent be sent recorded, then you can prove that the letter was sent.Littlewoods catalogue - won back charges of £300 by default.
