    i've sent first and second letters. the reply from hsbc says interest rates are well publicised for both authorised and un authorised od. therefore they are not going to refund interest.they go on to say that if i go to the court they will win as all charges etc are set out in the info you have when i opened the account they believe they will win. BUT then they go on to say "hsbc is however mindful of the management time and irrecoverable legal costs that it it may incur in relation to such a claim. for these commercial reasons alone" bla bla bla.
    they want me to accept their offer which is £1047.58 less than i first requested.
    should i go to the financial ombudsman as the bank has advised me at the end of the letter?
    If i just dont reply will they automatically up their offer?

  • Hi should i send the perlimary leter requesting charges back to my accounts branch or head office and who should i address the letter too??

    No they won't automatically up their offer, write back and accept the offer in PART payment and tell them you are proceeding to court for the rest.
  • well it looks like i might be in a losing battle here, My bank as offered a defence and now the court want to know (should i say made an order) why i think these charges are unlaw full, cant seem to get any help or advice off no one, should i just throw in the towel or waht ? been going on for 5 months now

  • Hi and morning all,

    Right i have numerous accounts with the abbey national

    1 current account with overdraft of £2170 but not upto its limit
    1 current account always in credit even if only a few £'s
    1 savings account usually under £200 in it
    2 childrens savings accounts about £150 in each

    The account that is overdrawn i have calculated that the charges due to me is approx £5000 give or take this is the account obviously that i want to claim on but none of the others. what i am concerned about is that they may ask me to close the other accounts. Can they do this. obviously i would be paying back the overdraft but want to keep the other current account.

    Before i proceed sending the initial letter i would like to make sure that they wont close all or most of my accounts..
