Bank :- Barclays
Amount Claimed:- Lost some old statements so no figure
Ammount Paid :- £530
Stage:- Just wrote a letter no threats just said the charges were disproportionate to their cost.
I wrote the letter on the 13 Oct 2006 to local branch standard letter bank a week later saying they were looking at it I would hear in a few weeks. Letter from bank on 11 Nov 2006 . Saying The Terms and Conditions of my bank account allowed them to do it. BUT AS A GOODWILL GESTURE HERE'S £530 pound.

You do need to send a schedule of charges. This should be a breakdown of EVERY charge individually listed. You need to list what the charge is for, the date of the charge, and the amount of the charge.
If you have done a spreadsheet, this will include every charge listed individually already. This (I haven't checked Martins one yet) should give you two total figures. One for the charges on their own, and one for the interest on all the charges add up together. The spreadsheet should count as your schedule of charges in court.
You can only use the spreadsheet as a schedule of charges in court. It's only in court that you can claim the interest. Up untill you issue the court claim, you can only claim for the amount of the charges with no interest added.How many surrealists does it take to change a lightbulb?

My daughter has overdrawn this month (the first time ever since she has been with her bank) It wasnt a large amount but they are charging her £8 a day for 5 days then £25.00 because they had to honour a direct debit. Now obviously this isnt a big amount and not enough to threaten court etc. But it is still a lot for her as she lives on her own and has all her bills to pay. I take it she is eligable to get these fee's back but who does she contact. She has already spoken to someone on the phone and they said she had to pay them. I told her to put it in writing but just wanted to make sure of the facts before she does. does she address this to the bank manager????0

I am currently at the Court stage with my claim on a business account.
You need to follow a certain process in requests for info and letters to your Bank then they will know you mean business.
Nice to see some familiar names on this thread-listen to their advice guys-they know their stuff!

Keith-Have you sent a copy of the spreadsheet of your charges to your Bank already? Did you file using Money claim online?If so,have you applied interest to this claim?
Spriggsy-you have come this far! Don't give up-it seems once all the info is sorted here,all will become clear.The banks usually defend their postion(seems like a waste of money to me)-but I don't think a case has yet been tested in court,they settle at the Court door-keep your nerve.
I am sure the wording for your Court bundle will be posted by the powers that be very soon-so you know what you are talking about and know what to send.Be patient.Fabi x0 -

Hi,
Seeking £360 in unfair charges from Barclaycard. Sent letter on 27th Oct saying i was seeking this back. Received bog standard reply(and to be honest very abrupt). Send second letter with spreadsheed of charges saing you have 14 days to refund the money last Friday(they received it yesterday). Letter i got today was they have taken my complaint on and i will hear off them by the 7th Dec(this goes over the 14 days i gave them in second letter)
Rang them up to discuss complaint and they had put £144back onto my account today!!
I said, i would accept that as part payment and would be seeking the rest. They said that was all they were willing to offer. Should i go straight to moneyclaim or send a third letter seeking the £216 they owe me. Did stress to them that if it went to court Barclaycard would be liable to £216 + costs + 8% interest0 -
Hi,
Just a quick question. I am about to submit my claim to my local Sheriff's office in Scotland and just wanted to confirm a couple of things. From starting correspondence with my bank until this stage the dates of charges being claimed are now over 6 years by a couple of months. Will this cause a problem with my claim?
Also, when I send the spreadsheet as back-up should I include the column with the 8% interest?

In Scotland you can only claim back over the past 5 years so as long as the claim is for the previous five years at the point you started correspondance with them.0
