    i sent the letter to abbey asking for list of all charges over past 6 years .. what i received this morning was a letter from abbey stating my overdraft on 1 of our accounts is due to expire and they are not going to renew it for the same amount .. instead of 900 they are reducing it to 500 and to make sure e our account is in its new limit if not we will be charged . also goes on to say you should also know you'll have to pay back your o/d immediately if we ask you to...
    this is a direct result of me sending them the letter about requesting a list of all charges .

    i have already opened new account with a&l as recomended on martins site ..just incase they closed our account .. but i haven't made the swop over yet as a&l can't comfrim if they will meet our exisiting o/d ..as at moment they have only offered us 550.
    the letter from abbey says its due to expire on 1st january ? can they do this and is there a possiblity they will also do the same on our main account ?

    i worked out over last 3years we have paid abbey about £400 in charges ...but can't check back further as chucked out old statements so awaiting for the list from them .. is this worth my while do you think ? ..
  • Hey Guys, I was looking to what you think I should do next?

    I sent a letter and a statement of charges to the Abbey a few weeks ago, and this morning recieved a letter informing me that they have carried out a 'full investigation' and assure me that the charges 'do not contravene the regulations' and therefore thay cannot agree to refund all of them, however as a gesture of goodwill they are prepared to refund £495.00

    Now, initially I asked them for £800 which was the total amount I paid in bank charges, with interest.

    They wrote the following.

    "I reviewed the literature and information you recieved when opening your account, including terms and conditions. This explains that charges will be applied if you do not keep to the terms of the account. Because of this, I believe we have been fair and open in telling you about them. The charges were correct, because you did not have enough money in your account to cover payments requested from it. When I looked at the history for your account I found that, unfortunately, this was not the first time this has happened."

    I don't know whether I should follow this up and request the total amount, or stick to the amount they are offering to give me..

    What do you guys think?
  • If your bank do not beleive the charges 'do not contravene the regulations' why are they prapared to give you a goodwill gesture of £xxx???

    I think you should nicely decline this offer and insist on the full amount!!

    My husband is in an IVA and we are currently pursuing an amount of over 25K in business bank charges from HSBC. However on the 24th October I sent my prelim letter to HSBC requesting refund. On 28th October got letter from Eversheds solicitors (Max Recovery) stating the debt with HSBC for 22,400(I am guessing although not stated, already included within IVA) had been transeferred to them on the 3rd Oct 06(how convenient and very strange) Do I still go for HSBC even though debt assigned. I did not realise the debt could be assigned as HSBC agreed to IVA back in Febary 2006. Why would they assign it when I have started to reclaim charges any one know??
    IP fully aware of going after bank charges. It seems odd they should send us this leter which was dated the 28th October 2006 three days after prelim letter sent and recieved by HSBC.

    On Wednesday Barclays agreed to pay us £2,500 in charges. It was due at court on Friday. So far we have had nearly £7000 of our money back from various banks. I thought this one would end in court but they settled at the last minute. Thanks everyone for all your help.

    So far in my quest of getting my wife's charges back, I have asked for the account charges which Lloyds have done for me, I have then sent the letter asking for it back, on which there reply was "no way", my next step was the court and I have paid the charge required, lloyds have set a defence, I filled the extra paperwork out which was sent via the post. This morning I recieved a letter from the solicitors of lloyds stating

    "We enclose herewith the defendant's completed allocation questionaire in the above claim pursuant to the order made by Northampton County Court on the 24th October 2006 and confim that the original has been filed at the county court accordingly.

    Kindly acknowledge safe receipt and if you have not already done so, please let us have a copy of your allocation questionaire at your earleist convenience".

    does anyone know what I should do if anything? and what the procedure is from here, is there anything else I need to do? or is it case of sitting tight, if so, for how long?

    sorry for the amount of questions, but neither myself or my wife's really know's on what we should be doing next!.

    Go with the standard letter accepting their offer in part payment and you will persue the rest in court.

    According to the CAG's Court Bundle you need to send details to the court and to the bank's soliciter so presumably that is what they are asking for if you haven't already sent it. If you have, then just wait.

    If you still have your Allocation Questionnaire, you should send a copy to Lloyds TSB Solicitors (is it Secchari, Clarke & Mitchell??). If you have already sent the AQ back to Court, it doesn't matter. Next it is a matter of waiting until you get a Court date, once you get that you will be asked by the Court to send your relevant documents that you are going to use in your Court claim to them and the Solicitors.
