My partner has today received a response from his letter asking for the charges to be reimbursed to him, we used the letter template recommended and enclosed a detailed list of the charges and dates taken.
Here is a small section from the letter received;
" We have considered and responded to the Office of Fair Trading's statement of April 2006. We do not accept the Office of Fair Trading's findings in relation to credit card fees. We are concerned that the Office of Fair Trading has publicly called into question the setting of charges applied to other products, including current accounts. The Office of Fair Trading has restricted its investigation to credit cards and made no attempt to consult with RBS or the industry in relation to other, entirely different products.
Consequently, against that background, we must differ with the views expressed in your letter and will not be refunding any of the charges applied to your bank."
Has anyone else received a letter of this nature from Natwest? Do we now go striaght to small claims or do we send another letter?

Can anyone advise?I have used the prepared letters word for word to reclaim bank charges and have not had any joy yet. I am at the stage where the bank has just filed a defence to the court and they dispute the full amount of the claim,their solicitors have prepared an A4 sheet of legal jargon,the main gist of which is "there is no breach of contract,the charge therefore cannot be a penalty,consequently there is no requirement that the charge be a pre-estimate of the banks loss."The charges are for banking services,and are not damages nor a penalty,the bank is entitled by contract to impose the charges,which are fair and reasonable.It is denied that the charges are unlawfull or contravene any statute or regulation." Whilst this has not detered me from my final goal of recovering this money, i find myself reluctant to reply to this untill i feel confident of my answers, for fear of shooting myself in the foot!!!0

would you believe i posted my letter saying have not received any statements " 40 day dpa ignored letter" and first thing this morning a huge envelope came through letterbox with statements going all the way back o when my husband opened account in 1995. thankfully he didnt start incurring charges till early 2000 so am hoping we will get most of the 6 years returned. i have highlighted the charges such as " £25 DD returnned" but do i also highlight the amounts they have charged for interest when he went over his agreed £750 overdraft limit and all other interest charges?0 -

I am new to this forum and am just about to begin action against Lloydstsb,
Amount claimed: £1900
I am just really unnerved by some of the threads I have read about Lloyds. Does anyone have any tips on dealing with them? I also have a £13,000 loan so if they decide to foreclose heaven knows what I would do. Any advice?0 -

I have begun action again LloydsTSB today hopefully to get back nearly £2000 worth of charges. I have read many of the threads related to them and have been very discouraged. Can anyone out there provide tips and hints on dealing with Lloyds to get the best result?0 -
