Data Protection Act 1998
Subject Access Request
Dear Sir/Madam
ACCOUNT NUMBER: xxxxxxxxx (or multiple numbers if more than one account)
Please supply me with a complete list of transactions and charges relating to my banking history with your organisation. Alternatively, a complete set of statements for that period will be acceptable.
Additionally, where there has been any event in my account history over this period which has required manual intervention by any member of your staff, or any other person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention, or other evidence of that manual intervention in relation to my banking business with you.
If you are unable to supply this data because there has been no such manual intervention, then please be so kind as to confirm this in your response.
I enclose the statutory maximum fee of £10. You have 40 days in which to comply. Furthermore, if I discover that you have levied disproportionate penalties against me, then I shall be reclaiming them, and also reclaiming the enclosed £10 Data Protection Act subject access request fee.
If there is specific information which you require in order to satisfy yourself as to my identity, please let me know by return. However, please note that the above address is the one which you normally use to communicate my private business to me and which you have hitherto found to be acceptable.
I would be happy to collect the Data from my local branch.
Yours faithfully,
[name]

So what if it's a bank account I had but that has since been closed?
The reason I ask is that in 1999 I opened a student account with Barclays. I arranged for my bursary to be paid into this account and for a £300 overdraft facility. The first bursary payment never went into the account and I was overdrawn. However, the overdraft was not for £300 either- it was for £100. After a few months the bill mounted up to about £400ish. My lovely mum paid the account off for me because Barclays told me they were closing my account and the outstanding charges must be paid in full.
So now I know this was wrong but can I do anything about it without any of the old account information?0 -

The story: Sent letters as per Consumer Action Group, filed claim with MoneyClaim - received notice of intent to defend, and Court Allocation Questionaire - paid additional Court Allocation fee (£100) then received letter from banks solicitors offering to settle out of court for claim and court costs.
I also bank with LTSB and have worked out that with interest, they would owe me about £800 back in charges (£650 + interest)
However, i have a loan with them whcih I still owe some £13000 on, and im worried that they will simply call this in if I issue a claim for my charges (I have written the standard letter 1 and letter 2 threatening court action -to which they are unfazed).
I have however, just successfully claimed for £500 from Natwest credit card, and hope Barclaycard to follow suit shortly inthe next 2 weeks but my worry is with challenging LTSB because of the loan.
did you have a loan with them if you dont mind me asking or has anyone else had a similar experience with LTSB, and did they close your account?
thanks, dan0 -
i filed a claim via moneyclaimonline against natwest and barclaycard just to be clear0

jiji you can only go back 6 years for claiming the bank charges so it depends when the charges were accrued.
Can posters please keep this thread for Success Stories and this one for questions as your question may not be answered here.

I know this has been covered but for the life of me I cant find it!! If the bank ignores the DPA request and it goes over 40 days, I know I need to report them to the information commissioner but do I need to do anything else or does the information commissioner give them a kick to send me the info?!0
